{"id":3926,"date":"2023-09-12T06:00:00","date_gmt":"2023-09-12T06:00:00","guid":{"rendered":"https:\/\/uniontrack.com\/blog\/?p=3926"},"modified":"2023-09-10T00:18:57","modified_gmt":"2023-09-10T00:18:57","slug":"anti-labor-state-laws","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/anti-labor-state-laws","title":{"rendered":"Anti-Labor State Laws Threaten Workers\u2019 Rights, Undermine Unions"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/uniontrack.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">UnionTrack<\/a><\/p>\n\n\n\n<p>For all the progress that has been made within the labor movement over the last few years, there have still been some significant setbacks, particularly at the state level. While some state legislators have passed legislation that protects workers and encourages union growth, others have worked to suppress workers rights and weaken unions.&nbsp;<\/p>\n\n\n\n<p>Here\u2019s a look at some of those efforts.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Florida Passes New Union Dues Law&nbsp;<\/h4>\n\n\n\n<p>In May 2023, Florida Governor Ron DeSantis signed SB 256 into law. It\u2019s a piece of legislation that restricts public sector unions\u2019 abilities to collect dues and threatens their ability to operate in the state.&nbsp;<\/p>\n\n\n\n<p>\u201cThe new law is state-sanctioned harassment of Florida&#8217;s public sector workers when we should be supporting and celebrating their contributions,\u201d laments Florida <a href=\"https:\/\/www.jacksonville.com\/story\/opinion\/columns\/guest\/2023\/05\/21\/some-public-sector-unions-have-hard-road-ahead-under-new-florida-law\/70220826007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rep. Angie Nixon<\/a>, a former member of the Florida Public Services Union.&nbsp;<\/p>\n\n\n\n<p>The law has two main components:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>It bans automatic paycheck deductions for public sector union dues.&nbsp;&nbsp;<\/li>\n\n\n\n<li>It requires public sector unions to provide data about membership numbers to prove they represent at least 60 percent of the total bargaining unit. If not, they can be decertified.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Such policies could spell disaster for public sector unions in the state, as is the intent of those supporting the legislation \u2014 although they claim it gives workers more freedoms. Unions are fighting back by hosting membership drives to encourage people to join and filing lawsuits to stop the implementation of the legislation.&nbsp;<\/p>\n\n\n\n<p>\u201cIt&#8217;s kind of like do or die, because this law is ultimately an attack on working class people,\u201d says <a href=\"https:\/\/www.wlrn.org\/government-politics\/2023-06-30\/floridas-new-union-law-sb-256\" target=\"_blank\" rel=\"noreferrer noopener\">Se\u2019Adoria \u201cCee Cee\u201d Brown<\/a>, president of American Federation of State, County &amp; Municipal Employees (AFSCME) Local 199.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Texas Eliminates Mandatory Water Breaks for Construction Workers<\/h4>\n\n\n\n<p>At a time when parts of the country are dealing with record heat waves, Texas Governor Greg Abbott signed a bill that will nullify local ordinances in the cities of Austin and Dallas that mandate 10-minute breaks every four hours for construction workers. The law also goes one step further and also prevents any other cities from passing similar laws.&nbsp;<\/p>\n\n\n\n<p>Nicknamed the \u201cdeath star\u201d law, it essentially strips workers of basic protections and denies local governments the ability to pass laws that protect their citizens if such laws are in conflict with state law. City leaders, unions, and labor advocates are calling it an overreach of government that will result in higher death rates for construction workers.&nbsp;<\/p>\n\n\n\n<p>\u201cIn the midst of a record-setting heatwave, I could not think of a worse time for this governor or any elected official who has any, any kind of compassion, to do this,\u201d said <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/jun\/23\/greg-abbott-texas-governor-bill-water-breaks-heatwave\" target=\"_blank\" rel=\"noreferrer noopener\">David Cruz<\/a>, the communications director for League of United Latin American Citizens National, a Latino civil rights organization.<\/p>\n\n\n\n<p>\u201cThis is an emergency,\u201d warns Texas AFL-CIO Deputy Director of Policy and Politics <a href=\"https:\/\/www.nbcnews.com\/science\/science-news\/backlash-brews-texas-law-eliminates-mandatory-water-breaks-rcna92961\" target=\"_blank\" rel=\"noreferrer noopener\">Ana Gonzalez<\/a>. \u201cTexas is the deadliest state when it comes to construction, where one worker dies every three days in our state.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"585\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/09\/UNI359S-TWO-1024x585.jpg\" alt=\"Worker wiping sweat from his brow; Anti-Labor State Laws concept\" class=\"wp-image-3928\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/09\/UNI359S-TWO-1024x585.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/09\/UNI359S-TWO-300x171.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/09\/UNI359S-TWO-768x439.jpg 768w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/09\/UNI359S-TWO.jpg 1400w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n&nbsp;<h2 class=\"wp-block-heading\">Tennessee Codifies Right to Work<\/h2>\n\n\n\n<p>While some states have been rejecting right-to-work laws, Tennessee has voted to enshrine right-to-work in its constitution. Tennessee became a right-to-work state in 1947, but voters voted to codify that right in November 2022, essentially making it nearly impossible to reverse course.&nbsp;<\/p>\n\n\n\n<p>Supporters of the amendment say they want it in the constitution to protect the state as right to work should the federal government pass legislation that outlaws the right to work. Those against it say it\u2019s unnecessary; the amendment only takes away the option for the state\u2019s right-to-work status to change in the future.&nbsp;<\/p>\n\n\n\n<p>\u201cFuture generations are cut out of any opportunity to amend it if they need to,\u201d says <a href=\"https:\/\/www.wjhl.com\/news\/your-local-election-hq\/local-union-lawmaker-share-thoughts-ahead-of-amendment-1-vote\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ken Osborne<\/a>, an officer with United Association of Journeymen and Apprentices of the Plumbing and Pipe Fitting Industry (UA) Local 538. \u201cIt\u2019s going to be there until you have a constitutional convention or until a major miracle comes up and they amend the law.\u201d<\/p>\n\n\n\n<p>Disappointed by the results of the vote even in a state that doesn\u2019t have a strong union presence, <a href=\"https:\/\/mlk50.com\/2022\/11\/07\/passage-of-the-right-to-work-amendment-1-would-have-lasting-impact-on-workers\/\">Kevin Bradshaw<\/a>, president of Memphis and West Tennessee AFL-CIO Labor Council, blames the results on a lack of awareness of what unions do for working people.&nbsp;<\/p>\n\n\n\n<p>\u201cWorking people don\u2019t understand what unions are really about,\u201d says Bradshaw. \u201cRight-to-work is not a right to work. It\u2019s a right to get fired.\u201d<\/p>\n\n\n\n<p>Unions have a critical role to play in educating working people about how unions protect them and why they should be voting to strengthen, not weaken, unions. The labor movement needs more people to stand together in solidarity and lobby against anti-labor legislation that is stripping away workers\u2019 rights.&nbsp;<\/p>\n\n\n\n<p>Leaders can use a tool like <a href=\"https:\/\/uniontrack.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">UnionTrack\u00ae ENGAGE\u00ae<\/a> to engage members in union advocacy to rally more support for their
