{"id":3678,"date":"2023-05-30T06:00:00","date_gmt":"2023-05-30T06:00:00","guid":{"rendered":"https:\/\/uniontrack.com\/blog\/?p=3678"},"modified":"2023-05-27T18:57:47","modified_gmt":"2023-05-27T18:57:47","slug":"union-news-federal-developments","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/union-news-federal-developments","title":{"rendered":"Union News Spring 2023: 3 Federal Developments to Watch"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/www.uniontrack.com\/\">UnionTrack<\/a><\/p>\n\n\n\n<p>Though President Biden\u2019s record as a pro-labor president has been tarnished by his and Congress\u2019 intervention in the 2022 <a href=\"https:\/\/uniontrack.com\/blog\/rail-unions\" target=\"_blank\" rel=\"noreferrer noopener\">rail workers\u2019 contract negotiations<\/a>, his administration remains attentive to the rights of working people and the unions that fight for those rights.<\/p>\n\n\n\n<p>\u201cBiden has been the most pro-worker and pro-union president in my lifetime, and I\u2019m almost 50,\u201d says <a href=\"https:\/\/tcf.org\/content\/report\/what-biden-has-done-and-still-can-do-for-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">Aaron Sojourner<\/a>, a senior researcher at the W.E. Upjohn Institute for Employment Research. \u201cYou\u2019d have to go back to F.D.R. to get anybody close.\u201d<\/p>\n\n\n\n<p>Among his many efforts on behalf of workers and unions, Biden has appointed pro-union people to key positions in his administration and organized a task force focused solely on empowering workers.<\/p>\n\n\n\n<p>That momentum continues. As we\u2019ll see below, some of the U.S. government\u2019s most recent initiatives include designating labor advisors for federal contract compliance, increasing penalties for illegally firing unionizing employees, and reintroducing the PRO Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Biden Requires Labor Advisors to Supervise Federal Contractors<\/h2>\n\n\n\n<p>As <a href=\"https:\/\/www.govexec.com\/management\/2023\/01\/white-house-will-require-agency-labor-advisors-oversee-federal-contractors\/381926\/\" target=\"_blank\" rel=\"noreferrer noopener\">Erich Wagner<\/a>, a senior correspondent for Government Executive, explains, although federal government contracting laws \u201coften stipulate that tasks should be performed by an agency\u2019s labor adviser, there is no requirement that agencies designate an employee to serve in that role, and many operate without one.\u201d<\/p>\n\n\n\n<p>The latest actions from the White House seek to change that.<\/p>\n\n\n\n<p>One of the recommendations of the White House Task Force on Worker Organizing and Empowerment was to assign labor advisors to ensure federal contractors\u2019 compliance with labor laws. On January 10, 2023, the Office of Management and Budget (OMB) issued a <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2023\/01\/M-23-08-Labor-Advisor.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">memorandum<\/a> to the heads of executive agencies and departments outlining the role of these labor advisors, which includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Promoting awareness and understanding of labor laws.<\/li>\n\n\n\n<li>Developing training on labor law requirements.<\/li>\n\n\n\n<li>Assisting contractors in addressing and preventing labor law violations.<\/li>\n<\/ul>\n\n\n\n<p>\u201cThe guidance adds another layer of pro-labor policy to the Biden administration\u2019s approach to its workforce,\u201d writes <a href=\"https:\/\/www.federaltimes.com\/acquisition\/regulations\/2023\/01\/17\/white-house-memo-establishes-labor-advisors-on-federal-contracts\/\" target=\"_blank\" rel=\"noreferrer noopener\">Molly Weisner<\/a>, a staff reporter at Federal Times.<\/p>\n\n\n\n<p>The labor advisors will also \u201chelp agencies avoid employment violations that can result in costly backpay, lawsuits and erosion of trust in the $600 billion federal procurement system,\u201d Weisner continues.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"806\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image1-4.jpg\" alt=\"Worker loading boxes in shipping yard; union news federal developments concept\" class=\"wp-image-3681\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image1-4.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image1-4-300x202.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image1-4-1024x688.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image1-4-768x516.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">NLRB Expands Penalties for Companies That Illegally Fire Unionizing Workers<\/h2>\n\n\n\n<p>Though it is illegal, workers are often fired for trying to unionize.<\/p>\n\n\n\n<p>Employees can file unfair labor practice grievances with the NLRB if they are fired under false pretenses. However, penalties are often either not enforced or are so minor that companies accept them as a small price to pay for keeping out unions.<\/p>\n\n\n\n<p>\u201cThe consequences for skirting the law are minimal\u2014in many cases, an NLRB judge will only order an employer to cease and desist any unfair labor practices,\u201d explains <a href=\"https:\/\/time.com\/6221176\/worker-strikes-employers-unions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alana Semuels<\/a>, senior economics correspondent at TIME magazine.<\/p>\n\n\n\n<p>\u201cSometimes employers will be required to offer terminated employees their jobs back and reimburse them for back pay or job search expenses.\u201d They may even have to pay a minimal court-ordered fee, Semuels adds.<\/p>\n\n\n\n<p>The NLRB is attempting to change this and better protect workers.<\/p>\n\n\n\n<p>On December 13, 2022, the NLRB issued a make-whole remedy rule to ensure workers are fairly compensated for unfair labor practices. \u201cEmployees are not made whole until they are fully compensated for financial harms that they suffered as a result of unlawful conduct,\u201d NLRB Chairman <a href=\"https:\/\/www.nlrb.gov\/news-outreach\/news-story\/board-rules-remedies-must-compensate-employees-for-all-direct-or\" target=\"_blank\" rel=\"noreferrer noopener\">Lauren McFerran<\/a> said.<\/p>\n\n\n\n<p>As a result of the rule, \u201ccompanies that illegally fire or demote unionizing workers can now be held responsible for workers\u2019 financial demise \u2014 including credit card late fees, lost housing or cars and health-care costs \u2014 in a move that could help some workers who have been fired from Starbucks and Amazon,\u201d the Washington Post\u2019s <a href=\"https:\/\/www.washingtonpost.com\/business\/2022\/12\/13\/unions-nlrb-firings-unions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lauren Kaori Gurley<\/a> writes.<\/p>\n\n\n\n<p><a href=\"https:\/\/truthout.org\/articles\/companies-that-illegally-fire-workers-will-now-have-to-pay-for-debts-incurred\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sharon Zhang<\/a> at Truthout reports this ruling will be applied retroactively to pending UFL cases. Zhang also notes, \u201cThese penalties could also apply to workers who were not fired but who were otherwise illegally retaliated against during a union campaign through wage cuts or demotions.\u201d<\/p>\n\n\n\n<p>It&#8217;s a nice win for workers and unions, who saw their rights whittled away during the Trump administration\u2019s NLRB. \u201cEnforcing the right of workers to come together on the job will help correct the vast gap between workers who want to form a union and those who are actually able to do so,\u201d writes <a href=\"https:\/\/www.americanprogress.org\/article\/the-nlrb-protects-workers-right-to-organize-yet-remains-underfunded\/\" target=\"_blank\" rel=\"noreferrer noopener\">Aurelia Glass<\/a>, research associate at the Center for American Progress.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image3-2.jpg\" alt=\"Barista at work; union news federal developments concept\" class=\"wp-image-3683\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image3-2.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image3-2-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image3-2-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/05\/image3-2-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Congressional Democrats Reintroduce the PRO Act<\/h2>\n\n\n\n<p>The Protecting the Right to Organize (PRO) Act was originally introduced into Congress in 2021. Many people at the time saw it as a seminal piece of legislation for protecting workers\u2019 rights.<\/p>\n\n\n\n<p>\u201cThe Protecting the Right to Organize (PRO) Act restores the right of workers to freely and fairly form a union and bargain together for changes in the workplace,\u201d is what the <a href=\"https:\/\/aflcio.org\/pro-act\" target=\"_blank\" rel=\"noreferrer noopener\">AFL-CIO<\/a> says.<\/p>\n\n\n\n<p>The original act passed the House, but not the Senate.<\/p>\n\n\n\n<p>It has since been reintroduced as the <a href=\"https:\/\/democrats-edworkforce.house.gov\/imo\/media\/doc\/richard_l_trumka_protecting_the_right_to_organize_act_hr20factsheet1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Richard L. Trumka Protecting the Right to Organize (PRO) Act of 2023<\/a>. Some of the key provisions in the act include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Preventing employer interference in elections.<\/strong> For example, the act would prohibit employers from compelling employees to attend captive audience meetings, and would allow elections to take place off-site in a neutral environment.<\/li>\n\n\n\n<li><strong>Holding employers accountable to labor laws.<\/strong> The act would enable the NLRB to impose personal liability on company leaders who violate labor labors and prevent employers from misclassifying their employees.<\/li>\n\n\n\n<li><strong>Empowering workers to organize<\/strong>. The act would give the NLRB the power to enforce its own rulings and protect workers\u2019 right to strike or protest.<\/li>\n<\/ul>\n\n\n\n<p>\u201cThe introduction of this legislation solidifies the transparency, freedom, and fairness all workers deserve in the workplace, while also holding companies and executives accountable for violating their rights,\u201d says <a href=\"https:\/\/www.booker.senate.gov\/news\/press\/booker-menendez-announce-the-introduction-of-the-richard-l-trumka-pro-act-of-2023-to-protect-workers-right-to-organize\" target=\"_blank\" rel=\"noreferrer noopener\">Sen. Bob Menendez<\/a> (NJ).<\/p>\n\n\n\n<p>There\u2019s no guarantee the bill will pass through the current Congress, but as they have from the time it was first introduced, unions and labor advocates are lobbying lawmakers to make passing the PRO Act a top priority.<\/p>\n\n\n\n<p>As unions continue to lead this charge, they can use a tool like <a href=\"https:\/\/uniontrack.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">UnionTrack\u00ae ENGAGE\u00ae<\/a> to keep members informed about their progress and rally them around the common purpose of passing such key pieces of
