{"id":3516,"date":"2023-03-21T06:00:00","date_gmt":"2023-03-21T06:00:00","guid":{"rendered":"https:\/\/uniontrack.com\/blog\/?p=3516"},"modified":"2023-06-29T18:34:57","modified_gmt":"2023-06-29T18:34:57","slug":"derailment","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/derailment","title":{"rendered":"3 Ways Unions Can Help Prevent Another Major Toxic Train Derailment"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/www.uniontrack.com\/\">UnionTrack<\/a><\/p>\n\n\n\n<p>Things in the railroad industry need to change, now.<\/p>\n\n\n\n<p>The February 3, 2023, train derailment in East Palestine, Ohio, was not an isolated incident. According to data from the <a href=\"https:\/\/www.bts.gov\/content\/train-fatalities-injuries-and-accidents-type-accidenta\" target=\"_blank\" rel=\"noreferrer noopener\">Bureau of Transportation Statistics<\/a>, there were an average of 1,705 derailments per year from 1990 to 2021.<\/p>\n\n\n\n<p>While that number has been trending downward, especially since 2008, that\u2019s still more than four derailments per day in the U.S.<\/p>\n\n\n\n<p>And while not all of those derailments involve hazardous materials, too many of them do.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.politifact.com\/article\/2023\/feb\/16\/ask-politifact-weve-seen-reports-of-three-train-de\/\" target=\"_blank\" rel=\"noreferrer noopener\">Allan Zarembski<\/a>, director of the University of Delaware\u2019s railway engineering and safety program, says there have been about 10 to 20 derailments each year over the past 10 years that involved hazardous material leaks. Just since the East Palestine incident, there have been derailments in Montgomery County, Texas; Sarasota, Florida; and Gothenburg, Nebraska, that involved the release of hazardous materials (and likely others).<\/p>\n\n\n\n<p>Until there are industry-wide changes that prioritize safety over profits, these types of accidents will continue to happen. It\u2019s up to workers and their unions to lead the charge as advocates for safer and better working conditions in the railroad industry.<\/p>\n\n\n\n<p>Below are three important fronts in that fight.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Engage the Public by Calling Attention to Problems<\/h2>\n\n\n\n<p>One way unions can strengthen their call for changes in the industry is by getting the public involved in the fight.<\/p>\n\n\n\n<p>The people in the cities and towns where train derailments occur are the ones who suffer the most, but they often are unaware of the risks posed by the trains that run through their area.<\/p>\n\n\n\n<p>\u201cLocal communities don\u2019t know what\u2019s in these trains,\u201d says <a href=\"https:\/\/thehill.com\/policy\/energy-environment\/3864122-four-rail-borne-risks-moving-through-american-communities\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kristen Boyle<\/a>, an attorney with public interest law firm Earthjustice. \u201cLocal communities can\u2019t find out. They can\u2019t stop the trains from going through, and they have been unable to get safety regulations.\u201d<\/p>\n\n\n\n<p>Union leaders should be connecting with community leaders and sharing facts about the safety issues rail workers know all too well.<\/p>\n\n\n\n<p>Whether through town hall meetings, door-to-door canvassing, or news spots on local media, union leaders need to drive home the point to the public that rail carriers have historically prioritized profits over people and lobbied against safety regulations.<\/p>\n\n\n\n<p>An outraged public can be a powerful ally to an organized labor movement.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/03\/image2-1.jpg\" alt=\"Railway worker; derailment concept\" class=\"wp-image-3520\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/03\/image2-1.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/03\/image2-1-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/03\/image2-1-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/03\/image2-1-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Keep Pressuring Carriers for Better Working Conditions<\/h2>\n\n\n\n<p>Unions must also continue to use the negotiation process as a platform for change.<\/p>\n\n\n\n<p>The last round of contract negotiations between rail companies and industry unions made national headlines when carriers refused to meet workers\u2019 demands for sick leave. The threat of a national strike led Congress and President Biden to <a href=\"https:\/\/uniontrack.com\/blog\/rail-unions\" target=\"_blank\" rel=\"noreferrer noopener\">force a contract<\/a> on the unions that didn\u2019t include that basic workplace right.<\/p>\n\n\n\n<p><a href=\"https:\/\/hbr.org\/2022\/12\/u-s-railroads-and-the-pitfalls-of-systematic-understaffing\" target=\"_blank\" rel=\"noreferrer noopener\">Amanda Silver and Zeynep Ton<\/a> of the Good Jobs Institute posit that the companies\u2019 refusal to budge was a result of longtime profits-over-people strategies that have left them understaffed. \u201cU.S. railroad companies\u2019 refusal to grant paid sick leave to their workers has exposed a startling vulnerability in the American economy: Rail staffing levels are not high enough to allow employees to take time off when they are ill,\u201d write Silver and Ton.<\/p>\n\n\n\n<p>Workers are also at the mercy of unsafe practices and protocols on trains. There is no federal standard for the minimum number of staff on a train, so some trains that are over a couple miles long may only have one or two people working. The train that derailed in East Palestine only had 3 crewmembers, one of whom was <a href=\"https:\/\/www.cnn.com\/2023\/03\/04\/business\/east-palestine-derailment-single-person-rr-crew-rule\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">just a trainee<\/a>.<\/p>\n\n\n\n<p>Additionally, car inspection times have been reduced in the name of expediency, which leaves more room for error and accidents.<\/p>\n\n\n\n<p>And rail company attendance policies lead to exhaustion for workers. The \u201cabusive and punitive attendance policy is breaking apart families and causing locomotive engineers and other railroaders to come to work dangerously fatigued,\u201d asserts the <a href=\"https:\/\/www.npr.org\/2022\/09\/14\/1122918098\/railroads-freight-rail-union-strike-train-workers\" target=\"_blank\" rel=\"noreferrer noopener\">Brotherhood of Locomotive Engineers and Trainmen (BLET)<\/a>.<\/p>\n\n\n\n<p>These are all issues the rail unions will need to continue fighting in future contract negotiations. For now, that means building awareness among rail workers and maintaining momentum.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Advocate for Legislation That Protects Workers<\/h2>\n\n\n\n<p>Collectively, unions have a voice and the resources to push for legislative changes.<\/p>\n\n\n\n<p>At the federal level, the Department of Transportation is pushing to advance a proposed rule, the <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/07\/28\/2022-15540\/train-crew-size-safety-requirements\" target=\"_blank\" rel=\"noreferrer noopener\">Train Crew Staffing Rule<\/a>, that would require at least two crew members for most operations. It\u2019s a common-sense rule for which rail unions should lobby while everyone is focused on train safety.<\/p>\n\n\n\n<p>Also, the Senate introduced the <a href=\"https:\/\/www.brown.senate.gov\/imo\/media\/doc\/railway_safety_act_of_2023_text.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Railway Safety Act of 2023<\/a>, which has already garnered union support. \u201cThe provisions in this act add up to the end of the era of Precision Scheduled Railroading (PSR) and attempt to take back control of our nation\u2019s supply chain from Wall Street\u2019s \u2018profit at any cost\u2019 mentality,\u201d says <a href=\"https:\/\/smart-union.org\/smart-td-strongly-supports-bipartisan-railway-safety-act-of-2023\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jeremy Ferguson<\/a>, president of the International Association of Sheet Metal, Air, Rail and Transportation (SMART) Workers Transportation Division.<\/p>\n\n\n\n<p>At the state level, unions can support a number of legislatures that are considering train safety legislation, including bills in <a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=90&amp;ba=HSB88\" target=\"_blank\" rel=\"noreferrer noopener\">Iowa<\/a> and <a href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2023-24\/Pdf\/Bills\/House%20Bills\/1839.pdf?q=20230222052640\" target=\"_blank\" rel=\"noreferrer noopener\">Washington<\/a> to limit the length of freight trains in their states.<\/p>\n\n\n\n<p>The nation\u2019s attention is on railroad safety right now. Unions need to strike while the iron is hot.
