{"id":3448,"date":"2023-01-24T06:00:00","date_gmt":"2023-01-24T06:00:00","guid":{"rendered":"https:\/\/uniontrack.com\/blog\/?p=3448"},"modified":"2023-01-23T16:09:49","modified_gmt":"2023-01-23T16:09:49","slug":"rail-unions","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/rail-unions","title":{"rendered":"How the US Government Undermined the Country\u2019s Rail Unions"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/uniontrack.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">UnionTrack<\/a><\/p>\n\n\n\n<p>Way back in May 2020, UnionTrack wrote about how the Brotherhood of Locomotive Engineers and Trainmen (BLET) and other rail unions were <a href=\"https:\/\/uniontrack.com\/blog\/blet-rail-workers\" target=\"_blank\" rel=\"noreferrer noopener\">pushing rail carriers<\/a> for fairer time-off policies, fairer scheduling, and safer working environments.<\/p>\n\n\n\n<p>Two and a half years later, those requests have never been met.<\/p>\n\n\n\n<p>Instead, in December 2022, the federal government forced an end to three years of contract negotiations between American rail workers and carriers through a series of votes in Congress.<\/p>\n\n\n\n<p>Below is a recap of how those negotiations progressed and finally ended.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Three Years of Contract Negotiations<\/h2>\n\n\n\n<p>In November 2019, the 12 unions representing U.S. rail workers began to negotiate their new contract with U.S. rail carriers.<\/p>\n\n\n\n<p>Those negotiations are unique in U.S. labor because they are defined by the 1926 Railway Labor Act. The National Carriers\u2019 Conference Committee represents carriers\u2019 interests in these negotiations, and the act establishes a National Mediation Board (NMB) to enforce the contract.<\/p>\n\n\n\n<p>It is important to understand what was happening in the rail industry when negotiations began. As The Washington Post\u2019s <a href=\"https:\/\/www.washingtonpost.com\/business\/2022\/12\/03\/rail-workers-paid-sick-leave\/\" target=\"_blank\" rel=\"noreferrer noopener\">Julian Mark<\/a> reports, the industry lost 40,000 jobs between November 2018 and December 2020. A big reason for all those lost jobs was a practice called \u201cprecision scheduling,\u201d which stretches the U.S. rail system\u2019s workforce as lean as it can go \u2014 for the sake of carrier profits.<\/p>\n\n\n\n<p>\u201cWall Street at the time cheered the transition to a new [scheduling] system,\u201d Mark writes. \u201cIn 2019, Norfolk Southern and Union Pacific stocks rose 30 percent, and shares of Kansas City Southern jumped more than 60 percent.\u201d<\/p>\n\n\n\n<p>BLET President <a href=\"https:\/\/www.prnewswire.com\/news-releases\/what-we-always-knew-engineers-and-trainmen-are-essential-to-the-american-economy-301032584.html\" target=\"_blank\" rel=\"noreferrer noopener\">Dennis Pierce<\/a> criticized precision scheduling in March 2020 because of what it could do to workers during a pandemic:<\/p>\n\n\n\n<p>\u201cWhether it be recalling shop craft employees to sanitize locomotives, or recalling operating crews to backfill for those sick employees who should be out of the workplace healing, the railroads must get away from their Precision Scheduled Railroading job cutting mindset if they expect to do their part to get our great nation through this national emergency.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image2-3.jpg\" alt=\"Railway worker pictured in construction of subway; rail unions concept\" class=\"wp-image-3452\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image2-3.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image2-3-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image2-3-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image2-3-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Rail Workers Just Want Fair Time-Off and Staffing Policies<\/h2>\n\n\n\n<p>As the pandemic continued, so did precision scheduling.<\/p>\n\n\n\n<p>\u201cLest we forget, BNSF Railway and Union Pacific made billions in profit in 2021,\u201d <a href=\"https:\/\/therealnews.com\/corporate-billionaires-are-wrecking-the-supply-chain-just-look-at-the-railroads\" target=\"_blank\" rel=\"noreferrer noopener\">Mel Buer<\/a> at Real News wrote in July 2022, at the height of the global supply chain crisis.<\/p>\n\n\n\n<p>\u201cBut the cost of those profits, according to railroad workers and their advocates, has been incalculable. Profit-motivated, \u2018cost-cutting\u2019 decisions made by those at the top of the corporate hierarchy have ground the hardworking operators, engineers, and others working along the railroad into dust.\u201d<\/p>\n\n\n\n<p><a href=\"https:\/\/www.csx.com\/index.cfm\/library\/files\/working-at-csx\/policies\/fmla-rights-and-responsibilities\/\" target=\"_blank\" rel=\"noreferrer noopener\">Here\u2019s an example<\/a> of such a policy, from carrier CSX. Employees there do theoretically have access to 12 weeks of unpaid, job-protected leave. The catch is employees can only exercise that right if they:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Have worked for CSX for at least 12 months and logged 1,250 hours of service (that\u2019s equal to 50 weeks of work at 25 hours per week).<\/li>\n\n\n\n<li>Work at a location where CSX \u201chas at least 50 employees within 75 miles of the employee\u2019s worksite,\u201d which might not be the case for every worker.<\/li>\n\n\n\n<li>And give 30 days of advance notice, which undercuts anyone\u2019s ability to call off when they get sick. \u201cIf it is not possible to give 30-days\u2019 notice,\u201d CSX writes, \u201can employee must notify the employer as soon as possible and, generally, follow the employer\u2019s usual procedures.\u201d<\/li>\n<\/ul>\n\n\n\n<p>So, if a brakeman who\u2019s been on the job for four years gets COVID and needs to take some days off, he has to hope there are enough employees in a 75-mile radius and that his employer\u2019s \u201cusual procedures\u201d allow for same-day sick-day requests.<\/p>\n\n\n\n<p>If not, his unpaid leave might not be job-protected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">That\u2019s What Unions Fought For During Contract Negotiations<\/h2>\n\n\n\n<p>In the spring of 2022, the bargaining coalitions between rail workers and carriers met for three straight weeks to negotiate terms of the new contract. On the table were questions of pay as well as provisions for the healthcare and quality of life of workers.<\/p>\n\n\n\n<p>Multiple unions reported that the carriers came to the table in bad faith:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cThe railroads\u2019 offer of a net pay cut and demand for health care concessions are wholly unacceptable as they simultaneously tout record\u2013breaking profits,\u201d the AFL-CIO\u2019s <a href=\"https:\/\/ttd.org\/rail-negotiations\/bargaining-timeline\/\" target=\"_blank\" rel=\"noreferrer noopener\">Transportation Trades Department<\/a> says.<\/li>\n\n\n\n<li>\u201cAlthough all of the involved Unions would prefer to reach a voluntary agreement, it has become quite clear at this point that the rail carriers will not bargain in good faith to that end,\u201d the <a href=\"https:\/\/www.twu.org\/9826-2\/\" target=\"_blank\" rel=\"noreferrer noopener\">Transport Workers Union<\/a> wrote in June.<\/li>\n<\/ul>\n\n\n\n<p>Unions\u2019 leaders and members understood by this point that the carriers weren\u2019t going to budge on basic provisions such as meaningful time-off policies.<\/p>\n\n\n\n<p>And so the unions requested that the NMB step in to help move negotiations along.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image1-3.jpg\" alt=\"Female train driver; rail unions concept.\" class=\"wp-image-3451\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image1-3.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image1-3-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image1-3-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2023\/01\/image1-3-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">September: The National Mediation Board\u2019s Tentative Agreement<\/h2>\n\n\n\n<p>After a cooling-off period over the summer, the NMB helped the negotiating parties create a tentative agreement that included pay raises and bonuses for workers, but it ignored the main issue on workers\u2019 minds.<\/p>\n\n\n\n<p>Four of the 12 rail unions rejected the deal in part because of the carriers\u2019 unflinching sick-leave and attendance policies. SMART Transportation Division President <a href=\"https:\/\/www.cnbc.com\/video\/2022\/12\/01\/union-presidents-to-cnbc-we-will-support-those-who-support-us-now-in-the-general-election.html\" target=\"_blank\" rel=\"noreferrer noopener\">Jeremy R. Ferguson<\/a> tells CNBC that some of his union\u2019s members had their days off cut from five or six days per month to just one day per month.<\/p>\n\n\n\n<p>In that same interview, Michael Baldwin, president of the Brotherhood of Railroad Signalmen, noted that this was the first time he had seen all 12 unions talking about a single issue \u2014 sick leave \u2014 that was pertinent to all of them.<\/p>\n\n\n\n<p>In other words, rail workers across all crafts, roles, locations, and carriers were nearly in unison about needing fairer time-off policies. And they were ready to push for concessions that would allow them to take a day off whenever they (or their spouses, or their children) were sick and needed care.<\/p>\n\n\n\n<p>If no deal could be reached that accounted for better scheduling and attendance policies, the rail unions were going to strike on December 9, 2022.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Happened in Congress in December<\/h2>\n\n\n\n<p>On November 28, President Joe Biden called on Congress to approve the tentative agreement, which the Railway Labor Act empowers it to do. Biden\u2019s justification was to avoid a \u201cpotentially crippling national rail shutdown,\u201d <a href=\"https:\/\/www.cnbc.com\/2022\/11\/28\/biden-urges-congress-to-pass-legislation-to-avert-nationwide-rail-strike.html\" target=\"_blank\" rel=\"noreferrer noopener\">Zo\u00eb Richards<\/a> at NBC News reported at the time.<\/p>\n\n\n\n<p>In early December, the House passed a bill to enforce the tentative September agreement. Interestingly, the House\u2019s bill spun off a second bill to introduce seven days of paid sick leave into the contract.<\/p>\n\n\n\n<p>The first bill passed the Senate and got the president\u2019s signature.<\/p>\n\n\n\n<p>The second bill failed in the Senate.<\/p>\n\n\n\n<p>The new contract\u2019s provisions included pay raises through 2024 and immediate payouts to individual workers, <a href=\"https:\/\/www.progressiverailroading.com\/federal_legislation_regulation\/news\/House-votes-to-prevent-rail-shutdown-OKs-separate-sick-leave-measure--68083\" target=\"_blank\" rel=\"noreferrer noopener\">Progressive Railroading<\/a> reports. But there was little meaningful discussion of \u2014 let alone resolution to \u2014 workers\u2019 calls for fairer attendance policies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Reaction to the Bill<\/h2>\n\n\n\n<p>On December 5, Congressman <a href=\"https:\/\/www.youtube.com\/watch?v=zUPVjIUL-9k\" target=\"_blank\" rel=\"noreferrer noopener\">Peter DeFazio<\/a> (D-OR), Chair of the House Transportation and Infrastructure Committee, took to the floor of the House to call out the rail carriers and their handling of these negotiations:<\/p>\n\n\n\n<p>\u201cIt\u2019s time for the railroads to face the music. Precision scheduled railroading is an abject failure. Your service is atrocious, you treat your workers with no respect. Don\u2019t come crying to the Federal Railroad Administration and Congress to bail you out for your ineptitude, greed, and profit taking. If you can&#8217;t provide your workers with paid sick time because you don\u2019t have enough people working, well, then maybe the CEOs can take a shift in the rail yard to cover.\u201d<\/p>\n\n\n\n<p>The Los Angeles Times\u2019 <a href=\"https:\/\/www.latimes.com\/opinion\/story\/2022-12-01\/la-ed-railroad-strike-paid-sick-leave\" target=\"_blank\" rel=\"noreferrer noopener\">editorial board<\/a> condemned railroad companies and politicians alike:<\/p>\n\n\n\n<p>\u201cThe companies had less incentive to offer paid sick leave or make adjustments to their profitable, punishing scheduling systems knowing that Congress would probably intervene to block the strike and impose the tentative contract to avoid broader economic harm. Biden too made a calculated decision to prioritize avoiding a strike, while leaving the issue of improving working conditions for conductors and engineers for another day.\u201d<\/p>\n\n\n\n<p>The most powerful tool workers have in a labor dispute is collective action, whether that means collective negotiation or the collective withholding of labor.<\/p>\n\n\n\n<p>All you can rely on is one another in a labor dispute.
