{"id":3397,"date":"2022-12-20T06:00:00","date_gmt":"2022-12-20T06:00:00","guid":{"rendered":"https:\/\/uniontrack.com\/blog\/?p=3397"},"modified":"2023-01-12T21:23:10","modified_gmt":"2023-01-12T21:23:10","slug":"new-union","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/new-union","title":{"rendered":"After the Win: Bring a New Union to Life"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/uniontrack.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">UnionTrack<\/a><\/p>\n\n\n\n<p>As the dust settles after a hard-fought unionization campaign and <a href=\"https:\/\/uniontrack.com\/blog\/successful-union-election\" target=\"_blank\" rel=\"noreferrer noopener\">election victory<\/a>, it\u2019s time for the new union to develop a formal organizational structure, elect its leaders, and create its constitution and by-laws.<\/p>\n\n\n\n<p>These are labor-intensive tasks and critical to get right for the union to have a strong foundation and leadership.<\/p>\n\n\n\n<p>The greatest challenge to structuring the new union is encouraging member participation. Unions are democratic organizations whose strength depends on member engagement and involvement. The <a href=\"https:\/\/www.opeiu537.org\/AboutUs.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">Office of Professional Employees International Union (OPEIU) Local 537<\/a> perfectly describes a labor union as \u201ca democratically run organization owned and operated by its members.\u201d<\/p>\n\n\n\n<p>Members \u201celect union officers, executive board members, stewards, and rank-and-file bargaining team members; negotiate and ratify their contracts; and vote on changes to the union\u2019s Constitution and Bylaws,\u201d explains the <a href=\"https:\/\/nuhw.org\/about\/what-is-a-union\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Union of Healthcare Workers<\/a>.<\/p>\n\n\n\n<p>If members don\u2019t actively participate, the union will likely dissolve before it is truly formed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Determine the New Union\u2019s Organizational Structure<\/h2>\n\n\n\n<p>The first thing members of a new union need to do is determine the structure of the organization. While there may be some differences, most unions follow the same basic governing structure.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The General Membership<\/h3>\n\n\n\n<p>As the most important part of the organization, its members have the key responsibility of being actively involved in the union\u2019s operations, stresses the <a href=\"https:\/\/www.teamsters495.org\/members\/rights-responsibilities\/\" target=\"_blank\" rel=\"noreferrer noopener\">International Brotherhood of Teamsters (Teamsters) Local 495<\/a>. Involvement includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Attending membership meetings.<\/li><li>Nominating candidates and voting in local officer elections.<\/li><li>Submitting proposals for contract negotiations.<\/li><li>Reading union communications such as newsletters, emails, and social media posts.<\/li><li>Voting on collective bargaining agreements.<\/li><li>Participating in union activities such as member surveys and strikes.<\/li><\/ul>\n\n\n\n<p>Members \u201care the union and by engaging in some or all of these activities you can guarantee that the union is successful in representing your interests,\u201d says the <a href=\"https:\/\/www.massnurses.org\/labor-action\/your-role-as-a-union-member\" target=\"_blank\" rel=\"noreferrer noopener\">Massachusetts Nurses Association<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Executive Board or Committee<\/h3>\n\n\n\n<p>The governing body of a local union is the executive board or committee. It essentially works with union leaders to carry out the policies voted on by members and ensure that the union is meeting the expectations of the membership.<\/p>\n\n\n\n<p>As the <a href=\"http:\/\/memberpower.ufcw.org\/files\/2014\/05\/Executive-Board-Training-Handouts-Temp1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">United Food and Commercial Workers (UFCW)<\/a> explains, \u201cThe executive board exists as a leadership body to work with the elected officers of the local.\u201d Some of its duties include setting union goals, guiding union committee work, and monitoring the finances of the local, notes the UFCW.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Local Union Officers<\/h3>\n\n\n\n<p>Each local union officer serves a different purpose in the organization. The most common union officer positions and their key duties are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>President.<\/strong> A union vice president is tasked with supervising staff, supervising implementation of union policy and programs, and appointing representatives to union committees, among many other duties, as described by the <a href=\"http:\/\/aft1493.org\/executive-committee\/union-handbook-job-duties\/\" target=\"_blank\" rel=\"noreferrer noopener\">San Mateo Community College Federation of Teachers, AFT Local 1493<\/a>.<\/li><li><strong>Vice president.<\/strong> Some duties of the vice president, which are outlined by <a href=\"https:\/\/www.afscmelocal4001.org\/system\/files\/duties_of_officers_and_executive_board_0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">American Federation of State, County and Municipal Employees (AFSCME) Local 4001<\/a>, include assisting the president, acting as leader of chief stewards, and assuming the duties of the president if necessary.<\/li><li><strong>Secretary.<\/strong> The secretary is primarily responsible for keeping a record of membership and executive committee meetings and carrying out the correspondence of the local.<\/li><li><strong>Treasurer.<\/strong> The treasurer performs duties such as receiving and depositing funds for the union, maintaining financial records of the local, and preparing and submitting financial statements.<\/li><li><strong>Trustees. <\/strong>The trustees essentially see to the financial affairs of the union, to which end they conduct financial audits and report those findings to the executive board.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Committees<\/h3>\n\n\n\n<p>Committees are also an important part of the union structure, and each serves a different function in the organization\u2019s operations.<\/p>\n\n\n\n<p>Some of the most common committees are negotiating committees, election committees, constitution committees, community service committees, women\u2019s committees, and education committees. It\u2019s up to union members to decide which committees their union needs.<\/p>\n\n\n\n<p>While not every union looks the same, they all have the same basic organizational structure. The most important thing to remember when designing the structure of the union is that it needs to be a democratic process in which everyone has an equal voice in the formation of their union.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image3-1.jpg\" alt=\"Woman working on lap top which has image of person voting; new union concept\" class=\"wp-image-3402\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image3-1.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image3-1-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image3-1-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image3-1-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Hold Elections to Vote for Union Leaders<\/h2>\n\n\n\n<p>Elections are the heart of a democratic organization. \u201cLabor unions, whose express purpose is to provide more favorable workplace conditions for their members, are generally governed by the democratic ideal of free and fair elections for leadership,\u201d write <a href=\"https:\/\/www.americanprogress.org\/article\/unions-democratically-organized-corporations-not\/\" target=\"_blank\" rel=\"noreferrer noopener\">David Madland, Malkie Wall, Danielle Root, and Sam Berger<\/a> at the Center for American Progress.<\/p>\n\n\n\n<p>And while each local is responsible for conducting its own elections, they are guided by established federal law and each union\u2019s constitution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">There Are Regulations Governing Union Elections<\/h3>\n\n\n\n<p>The <a href=\"https:\/\/www.dol.gov\/agencies\/olms\/laws\/labor-management-reporting-and-disclosure-act\" target=\"_blank\" rel=\"noreferrer noopener\">Labor-Management Reporting and Disclosure Act (LMRDA)<\/a> is the defining federal legislation that governs union elections.<\/p>\n\n\n\n<p>Enforced by the Department of Labor\u2019s Office of Labor-Management Standards (OMLS), the LMRDA \u201cguarantees certain rights to union members and imposes certain responsibilities on union officers,\u201d explains the <a href=\"https:\/\/smart-union.org\/news\/lmrda-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">International Association of Sheet Metal, Air, Rail and Transportation Workers (SMART)<\/a>. This includes standards on how to conduct union elections.<\/p>\n\n\n\n<p>Some of the election standards in the LMRDA, as outlined by the <a href=\"https:\/\/cwa-union.org\/sites\/default\/files\/how_to_conduct_local_union_elections_participants_guide_v2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Communication Workers of America (CWA)<\/a> in its guide on conducting local union elections, are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Elections must be conducted at least every three years.<\/li><li>Election notices must be mailed to every member at least 15 days before the election.<\/li><li>Each member in good standing gets one vote.<\/li><li>Elections must be conducted as secret ballot elections.<\/li><li>Election results must be published.<\/li><\/ul>\n\n\n\n<p>A local union\u2019s constitution also governs elections, as noted in the LMRDA, insofar as it is consistent with federal law. The CWA\u2019s publication contains a good example of election rules in a union constitution.<\/p>\n\n\n\n<p>The OMLS also has a <a href=\"https:\/\/www.dol.gov\/agencies\/olms\/compliance-assistance\/publications\/guide-for-conducting-local-union-officer-elections\" target=\"_blank\" rel=\"noreferrer noopener\">comprehensive election guide<\/a> that can be useful for new unions as they navigate the important process of conducting union elections. This guide is particularly helpful for election committee members who should be guided by these three main principles when overseeing elections:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Remain fair and impartial to all candidates.<\/li><li>Follow federal and union election provisions.<\/li><li>Protect the democratic voting rights of members.<\/li><\/ol>\n\n\n\n<p>By following these principles, the election committee (and the larger organization) ensure union elections and encourage member participation in shaping the future of the union.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image1-2.jpg\" alt=\"Group of people in circle, having a discussion; new union concept\" class=\"wp-image-3400\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image1-2.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image1-2-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image1-2-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2022\/12\/image1-2-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Draft a Constitution That Governs the Union<\/h2>\n\n\n\n<p>Local unions must define the rules that govern the organization. Even if the new union is a local of a national organization, it still has to write and adopt its own constitution.<\/p>\n\n\n\n<p>The LMRDA requires all unions to adopt a member-approved constitution that \u201ccontains the fundamental principles by which the local is governed,\u201d notes the <a href=\"https:\/\/apwu.org\/news\/your-union-constitution-conflict#:~:text=Your%20local%20union%20constitution%20contains,been%20approved%20by%20the%20members.\" target=\"_blank\" rel=\"noreferrer noopener\">American Postal Workers Union (APWU)<\/a>. That constitution cannot violate federal or state laws, nor can it conflict with the constitution of the national union, explains the APWU.<\/p>\n\n\n\n<p>As a governing document, it needs to address all aspects of running a union, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Membership.<\/li><li>Officers\u2019 duties.<\/li><li>Salaries and benefits.<\/li><li>Elections.<\/li><li>Budget.<\/li><\/ul>\n\n\n\n<p>While this is certainly a monumental task, especially for a newly formed organization, it\u2019s not insurmountable. There are a number of resources, like the \u201cGuide for Drafting Local Union Bylaws\u201d from the <a href=\"https:\/\/uaw.org\/wp-content\/uploads\/2017\/02\/354-Guide-for-Drafting-Local-Union-Bylaws-COMPLETE-BOOK.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">United Autoworkers (UAW)<\/a>, available to help new locals draft their constitutions.<\/p>\n\n\n\n<p>What\u2019s particularly critical to remember is that all members must have the opportunity to participate in the creation of this document, and that it\u2019s a living document that can be changed by member approval if and when necessary.<\/p>\n\n\n\n<p>The importance of communication at this stage in the unionization process cannot be overstated.
