As president, he is making <a href=\"https:\/\/www.uniontrack.com\/blog\/pro-union-president\">efforts<\/a> to keep that promise. Here\u2019s a look at the current status of two of the most pressing labor-friendly initiatives of the Biden administration: the recommendations of the Task Force on Worker Organizing and Empowerment and the passage of the PRO Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Implementing Recommendations from the Federal Labor Union Task Force<\/h2>\n\n\n\n<p>Shortly after he took office, President Biden formed the <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/04\/26\/fact-sheet-executive-order-establishing-the-white-house-task-force-on-worker-organizing-and-empowerment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Task Force on Worker Organizing and Empowerment <\/a>and gave its members 180 days to deliver recommendations to empower workers to organize and bargain collectively with their employers.<\/p>\n\n\n\n<p>Four key goals are guiding those recommendations:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Positioning the federal government as a model employer in regards to worker organizing.<\/li><li>Facilitating worker organizing across the U.S.<\/li><li>Increasing the power of workers in underserved communities.<\/li><li>Increasing union membership.<\/li><\/ul>\n\n\n\n<p>The task force held its second meeting on October 6 to discuss the group\u2019s report, which promote the use of executive actions to advance a pro-worker agenda guided by the group\u2019s recommendations.<\/p>\n\n\n\n<p>When discussing the report they were to deliver to President Biden on October 23, <a href=\"https:\/\/www.reuters.com\/world\/us\/harris-says-key-labor-report-will-be-released-oct-23-2021-10-07\/\" target=\"_blank\" rel=\"noreferrer noopener\">Vice President Kamala Harris<\/a> said the information demonstrates the difficulties workers face when organizing. It shows how the federal government can and will make changes that will impact &#8220;every sector of employment.&#8221;<\/p>\n\n\n\n<p>According to Labor Secretary <a href=\"https:\/\/www.ny1.com\/nyc\/all-boroughs\/news\/2021\/10\/07\/white-house-labor-task-force-meets-unions-report\" target=\"_blank\" rel=\"noreferrer noopener\">Marty Walsh<\/a>, one issue the report addresses is to improve opportunities for people of color. \u201cProbably one of the biggest challenges that we have is making sure we are creating opportunities for young people of color to get into the workforce,\u201d says Walsh. \u201cThere&#8217;s more work to do.\u201d<\/p>\n\n\n\n<p>Two weeks after Biden received that report, the Department of Labor, the NLRB and the Equal Employment Opportunity Commission <a href=\"https:\/\/www.dol.gov\/newsroom\/releases\/sol\/sol20211110\" target=\"_blank\" rel=\"noreferrer noopener\">announced a joint commission<\/a> that intends to \u201craise awareness about retaliation issues when workers exercise their protected labor rights.\u201d<\/p>\n\n\n\n<p>The commission is designed to bring together the civil law enforcement capabilities of all three agencies to help protect workers against employers who try to retaliate unlawfully against any worker efforts to speak up about or take action regarding workplace concerns.<\/p>\n\n\n\n<p>The commission\u2019s first act will be an online conversation \u201cwith the employer community\u201d about the agencies\u2019 mission to protect workers against such retaliation.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2021\/11\/image2-3.jpg\" alt=\"group of young happy chefs in kitchen; Federal Labor Union Task Force concept\" class=\"wp-image-2767\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/11\/image2-3.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/11\/image2-3-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/11\/image2-3-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/11\/image2-3-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Advocating for Passage of the PRO Act<\/h2>\n\n\n\n<p>President Biden calls for passage of the Protecting the Right to Organize (PRO) Act in his economic recovery\/infrastructure bill, known as <a href=\"https:\/\/www.uniontrack.com\/blog\/american-jobs-plan-and-labor-interests\">The American Jobs Plan<\/a>.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.uniontrack.com\/blog\/pro-act\">PRO Act<\/a> has been languishing in Congress. If passed, it would:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Strengthen workers\u2019 right to unionize by overturning right-to-work laws.<\/li><li>Penalize employers that interfere with union elections.<\/li><li>Create recourse for employees who are illegally fired for participating in organizing activities.<\/li><li>Expand the rights of workers to strike and protest.<\/li><\/ul>\n\n\n\n<p>Because it would need Republican support to avoid the filibuster, which is unlikely to happen in a split chamber, the president included it in his infrastructure bill to increase the chances of its passage.<\/p>\n\n\n\n<p>So far, though, the president and his allies have been unable to push the American Jobs Plan through Congress. So, the PRO Act is still being held hostage in the political battle between Republicans and Democrats.<\/p>\n\n\n\n<p>In an effort to circumvent the need to pass the jobs plan to pass the PRO Act, the <a href=\"https:\/\/edlabor.house.gov\/imo\/media\/doc\/Committee%20Print.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">House Education and Labor Committee<\/a> attempted to include certain aspects of the PRO Act, namely penalties against employers, in the federal budget through the reconciliation process, which would prevent it from being stopped by a filibuster. It\u2019s another effort to overcome the deep political divide of the current Congress.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.politico.com\/news\/2021\/09\/21\/unions-reconciliation-bill-513423\" target=\"_blank\" rel=\"noreferrer noopener\">Dan Mauer<\/a>, director of government affairs for the Communications Workers of America, supports using the reconciliation process to pass these critical provisions of the PRO Act. \u201cAlthough some of the things in the PRO Act are not about budgetary issues, we thought that actually, there\u2019s a strong case that when you\u2019re issuing penalties on bad behavior, not only is that budgetary in nature, it\u2019s a great way of raising revenue,&#8221; he explains.<\/p>\n\n\n\n<p>With both the infrastructure bill and the reconciliation process currently struggling through Congress, there\u2019s no way to predict just if, when, or how the PRO Act will finally become law.<\/p>\n\n\n\n<p>As labor leaders and their allies continue to advocate
