{"id":2585,"date":"2021-08-17T06:00:00","date_gmt":"2021-08-17T06:00:00","guid":{"rendered":"https:\/\/www.uniontrack.com\/blog\/?p=2585"},"modified":"2021-08-30T20:57:21","modified_gmt":"2021-08-30T20:57:21","slug":"amazon-workers-union","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/amazon-workers-union","title":{"rendered":"After Alabama Defeat, U.S. Amazon Workers Continue the Fight"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/www.uniontrack.com\/\">UnionTrack<\/a><\/p>\n\n\n\n<p>Organizing Amazon workers is proving to be difficult. \u201cSo far, no effort to unionize Amazon has been successful in the company\u2019s 26-year history,\u201d writes <a href=\"https:\/\/www.pbs.org\/newshour\/economy\/teamsters-union-votes-to-make-organizing-amazon-workers-a-priority\" target=\"_blank\" rel=\"noreferrer noopener\">Joseph Pisani<\/a>, retail reporter at The Associated Press covering Amazon and online shopping.&nbsp;<\/p>\n\n\n\n<p>The most recent <a href=\"https:\/\/www.uniontrack.com\/blog\/alabama-amazon-union\">rejection of a union<\/a> by workers at the Bessemer, Alabama, Amazon fulfillment center was a blow to the labor movement that has been fighting (and failing) to unionize Amazon facilities in the U.S. and to the pro-union Amazon employees who have been waging battles to secure collective bargaining rights.<\/p>\n\n\n\n<p>\u201cThe defeat shows just how difficult it is for unions to get a foothold into one of the country&#8217;s massive employers when the company is willing to fight back,\u201d writes <a href=\"https:\/\/www.npr.org\/2021\/04\/16\/988020972\/big-union-loss-at-amazon-warehouse-casts-shadow-over-labor-movement\" target=\"_blank\" rel=\"noreferrer noopener\">Stephan Bisaha<\/a>, wealth and poverty reporter at the Gulf States Newsroom.&nbsp;<\/p>\n\n\n\n<p>But the rejection wasn\u2019t the death knell to unionization efforts at Amazon facilities that it could have been. \u201cSome labor experts say all the attention the Bessemer election brought to the labor movement was a good thing, regardless of the outcome,\u201d explains Bisaha. \u201cThe [Retail, Wholesale and Department Store Union] claimed that workers from other Amazon warehouses said they were inspired by what was happening in Bessemer and were interested in unionizing.\u201d<\/p>\n\n\n\n<p>Here\u2019s a look at some of those efforts to organize workers at Amazon facilities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fired Amazon Worker Organizing Staten Island Employees<\/h2>\n\n\n\n<p>In March 2020, Christian Smalls, former assistant manager at Amazon\u2019s JFK8 Staten Island, New York, warehouse led fellow workers in a walkout to protest unsafe working conditions at the facility. The company immediately fired him for violating social distancing rules during the pandemic.&nbsp;<\/p>\n\n\n\n<p>In response, Smalls filed a class-action lawsuit against the company, citing retaliatory action for his part in organizing the protest. He has also formed an independent union, the <a href=\"https:\/\/amazonlaborunion.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Amazon Labor Union<\/a> (A.L.U.), through which he is currently attempting to unionize more than 5,000 workers at four Amazon facilities in the borough.&nbsp;<\/p>\n\n\n\n<p>Establishing a union unaffiliated with any other major union is \u201cunusual,\u201d writes <a href=\"https:\/\/www.theguardian.com\/technology\/2021\/jun\/04\/amazon-workers-staten-island-christian-smalls\" target=\"_blank\" rel=\"noreferrer noopener\">Steven Greenhouse<\/a>, labor and workplace reporter at The New York Times. But Smalls is \u201cconvinced\u201d that creating an Amazon-workers-only union is the best way to bring Amazon workers together.<\/p>\n\n\n\n<p>\u201cWe have nothing to compare ourselves to,\u201d <a href=\"https:\/\/www.protocol.com\/amazon-labor-union-staten-island\" target=\"_blank\" rel=\"noreferrer noopener\">Smalls<\/a> says. \u201cThat puts us at an advantage. Workers can&#8217;t say we already tried it and failed. When talking to workers, we can say this is us creating this together as workers of Amazon. We&#8217;re all in this together.\u201d<\/p>\n\n\n\n<p>But that doesn\u2019t mean he is going at it completely alone. He does have the support of established labor unions and labor allies. <a href=\"https:\/\/www.theguardian.com\/technology\/2021\/jun\/04\/amazon-workers-staten-island-christian-smalls\" target=\"_blank\" rel=\"noreferrer noopener\">Stuart Appelbaum<\/a>, president of the Retail, Wholesale and Department Store Union, expresses his support for the A.L.U.\u2019s union drive, saying, \u201cAmazon workers need unions. I hope that Chris and others around the country will be successful.\u201d<\/p>\n\n\n\n<p>The A.L.U. organizers are planning to hold a union vote at the end of the summer.&nbsp;<\/p>\n\n\n\n<p>It\u2019s shaping up to be another uphill battle for Amazon workers. The company has already started interfering with unionization efforts by pushing anti-union messages at the facilities, issuing a safety warning about union organizers outside the facility, and installing a fence to keep organizers away from workers, reports Motherboard staff writer <a href=\"https:\/\/www.vice.com\/en\/article\/epnxkw\/amazon-sends-workers-safety-warning-about-unions\" target=\"_blank\" rel=\"noreferrer noopener\">Lauren Kaori Gurley<\/a>.<\/p>\n\n\n\n<p>\u201cThey\u2019re trying to scare workers,\u201d says <a href=\"https:\/\/www.ny1.com\/nyc\/all-boroughs\/news\/2021\/06\/18\/amazon-union-effort-staten-island-amazon-fulfillment-center-jfk-8-update\" target=\"_blank\" rel=\"noreferrer noopener\">Connor Spence<\/a>, a worker at JFK8 and a union organizer. \u201cThey want workers to be afraid so that they can\u2019t stand up for themselves.\u201d<\/p>\n\n\n\n<p>Time will tell if this independent union of Amazon workers will be able to overcome the company\u2019s union-busting activities to become the first to unionize in the U.S.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"800\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2021\/08\/image1-2.jpg\" alt=\"amazon packaging; amazon workers union concept\" class=\"wp-image-2588\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/08\/image1-2.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/08\/image1-2-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/08\/image1-2-1024x683.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/08\/image1-2-768x512.jpg 768w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">The Teamsters Make Amazon Unionization a Top Priority<\/h2>\n\n\n\n<p>While the A.L.U. conducts its own union drive, major unions are continuing their push to unionize Amazon facilities in the U.S.&nbsp;<\/p>\n\n\n\n<p>In fact, the Teamsters recently passed a <a href=\"https:\/\/teamster.org\/wp-content\/uploads\/2021\/06\/62421CONVENTIONRESOLUTIONAMAZON.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">special resolution<\/a> that launches a national effort to unionize Amazon workers. Dubbed the Amazon Project, the effort involves creating an Amazon Division within the union that is tasked specifically with organizing Amazon facilities.&nbsp;<\/p>\n\n\n\n<p>\u201cAmazon presents a massive threat to working-class communities and good jobs in the logistics industry,\u201d says <a href=\"https:\/\/www.nbcnews.com\/business\/business-news\/teamsters-vote-create-dedicated-amazon-division-unionize-workers-n1272292\" target=\"_blank\" rel=\"noreferrer noopener\">Randy Korgan<\/a>, the Teamsters\u2019 national director for Amazon. \u201cAmazon workers are calling for safer and better working conditions and with [this] resolution we are activating the full force of our union to support them.\u201d<\/p>\n\n\n\n<p>A key part of the union\u2019s national strategy is to bypass the traditional National Labor Relations Board (NLRB) union election process. Instead, the union will focus on pressure campaigns and \u201cshop-floor militancy\u201d actions such as \u201cshop floor strikes, city-wide strikes, and actions in the streets,\u201d according to the resolution.&nbsp;<\/p>\n\n\n\n<p>\u201cWe see challenges with an NLRB strategy,\u201d says <a href=\"https:\/\/prospect.org\/labor\/teamsters-union-taking-on-amazon\/\" target=\"_blank\" rel=\"noreferrer noopener\">Korgan<\/a>. \u201cWe want people to see this industry wasn\u2019t organized predominantly through an NLRB strategy to begin with.\u201d With this alternative approach to unionizing Amazon workers, the Teamsters seek to succeed where others have failed.&nbsp;<\/p>\n\n\n\n<p>\u201cWe will organize Amazon,\u201d asserts <a href=\"https:\/\/www.latimes.com\/business\/story\/2021-06-24\/teamsters-members-vote-to-organize-amazon-union\" target=\"_blank\" rel=\"noreferrer noopener\">James Hoffa<\/a>, president of the Teamsters.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Teamsters First Amazon Union Effort<\/h2>\n\n\n\n<p>A newly-constructed Amazon fulfillment center in Clay, New York is where the union is making its first efforts to unionize workers. Teamsters Local 317, supported by the Central New York Area Labor Federation, is leading the charge to organize employees at the warehouse to ensure fair wages and safe working conditions as soon as the center opens.<\/p>\n\n\n\n<p>\u201cUnion workers usually do better,\u201d says <a href=\"https:\/\/cnycentral.com\/news\/local\/local-unions-in-cny-preparing-to-make-amazon-warehouse-in-clay-countrys-first-unionize\" target=\"_blank\" rel=\"noreferrer noopener\">Mark May<\/a>, principal executive officer of the local. \u201cThey have a say. We think we will take a run at it to try to organize.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Some Amazon Workers Taking Alternative Actions<\/h2>\n\n\n\n<p>While the A.L.U. and the Teamsters ramp up efforts to form majority unions, some workers are embracing alternative measures. One such action is forming minority unions. With a minority union, workers could still receive labor union representation, make demands and take collective action. Amazon, however, would not be required to bargain for a contract.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/www.protocol.com\/next-for-amazon-workers-union\" target=\"_blank\" rel=\"noreferrer noopener\">Susan Schurman<\/a>, a distinguished professor in labor studies and employment relations at Rutgers University, this may be the best course for Amazon workers for now. By starting with a minority union, workers can then demonstrate the power of the collective and recruit workers until they have enough support to win an election and secure collective bargaining rights, she explains.&nbsp;<\/p>\n\n\n\n<p>\u201cAmazon is to the 21st century what the auto and steel industry were for the 20th century,\u201d says Shurman. \u201cIf workers in the United States want to have some kind of voice over what happens to them at work, there is only one way to get that. And that is to form or join a union.\u201d&nbsp;<\/p>\n\n\n\n<p>Workers can also come together and negotiate with management without forming a union at all. Labor laws protect workers\u2019 right to self-organize, notes <a href=\"https:\/\/fortune.com\/2021\/04\/13\/amazon-workers-union-efforts-collective-power-working-conditions-activism\/\" target=\"_blank\" rel=\"noreferrer noopener\">Patricia Campos-Medina<\/a>, executive director of The Worker Institute at Cornell University.&nbsp;<\/p>\n\n\n\n<p>One such independent group, <a href=\"https:\/\/www.amazoniansunited.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Amazonians United<\/a>, was formed by Amazon workers in Chicago in 2019 to bring workers together to stand up against the company and demand better working conditions. The group uses worker actions to make demands of the company.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/news.wttw.com\/2021\/04\/01\/amazon-employees-chicago-demand-accommodations-brutal-shift\" target=\"_blank\" rel=\"noreferrer noopener\">Robert Bruno<\/a>, professor of labor and employment relations at the University of Illinois, describes such \u201calternative labor organizations\u201d as \u201ceffective\u201d at helping workers achieve some concessions from companies, even though they aren\u2019t formally recognized as labor unions under the law. They do \u201cadvocate for workers and they use public advocacy campaigns\u201d to secure wins for workers, Bruno explains.&nbsp;&nbsp;<\/p>\n\n\n\n<p>No matter how Amazon workers come together, what\u2019s important is that they do. It will take collective groups standing in solidarity with each other and accepting the support of established unions and worker advocacy groups to build enough momentum to eventually unionize Amazon
