{"id":2463,"date":"2021-05-18T06:00:00","date_gmt":"2021-05-18T06:00:00","guid":{"rendered":"https:\/\/www.uniontrack.com\/blog\/?p=2463"},"modified":"2021-05-18T13:22:34","modified_gmt":"2021-05-18T13:22:34","slug":"labor-secretary-marty-walsh","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/labor-secretary-marty-walsh","title":{"rendered":"Biden Selects Labor Advocates for Key Positions: Labor Secretary Marty Walsh and NLRB Chairman Lauren McFerran"},"content":{"rendered":"\n<p>Ken Green<br>CEO &amp; Founder<br><a href=\"https:\/\/uniontrack.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">UnionTrack<\/a><\/p>\n\n\n\n<p>As a candidate, <a href=\"https:\/\/www.cnbc.com\/2020\/12\/01\/biden-promises-to-be-the-most-pro-union-president-and-rep.html\" target=\"_blank\" rel=\"noreferrer noopener\">President Biden<\/a> promised to be \u201cthe most pro-union president you have ever seen.\u201d In his first few months in office, he has taken steps to follow through on that pledge.&nbsp;<\/p>\n\n\n\n<p>Most notably, reports <a href=\"https:\/\/www.msnbc.com\/rachel-maddow-show\/president-biden-follows-through-his-pro-union-pledges-n1260228\" target=\"_blank\" rel=\"noreferrer noopener\">Steven Bennen<\/a>, MSNBC contributor and The Rachel Maddow Show producer, Biden has vocally supported the Amazon workers in their unionization efforts in Alabama and openly endorsed the passage of the <a href=\"https:\/\/www.uniontrack.com\/blog\/pro-act\">Protecting the Right to Organize Act<\/a>. He also fired the sitting general counsel of the National Labor Relations Board (NLRB) and nominated multiple labor advocates to key federal positions.<\/p>\n\n\n\n<p>Two of those new leaders, Labor Secretary Marty Walsh and NLRB Chairman Lauren McFerran, have long histories of supporting workers and unions.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image2-2.jpg\" alt=\"picture of Marty Walsh; Biden appoints Labor Secretary Marty Walsh and Lauren McFerran concept\" class=\"wp-image-2467\" width=\"568\" height=\"552\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image2-2.jpg 1135w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image2-2-300x292.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image2-2-1024x996.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image2-2-768x747.jpg 768w\" sizes=\"auto, (max-width: 568px) 100vw, 568px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Marty Walsh Expected to Prioritize Workers as Labor Secretary<\/h2>\n\n\n\n<p>It\u2019s no surprise that President Biden nominated former Boston mayor Marty Walsh to lead the Labor Department with Walsh\u2019s strong ties to unions, workers and labor advocacy.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A Lifetime of Unionism<\/h3>\n\n\n\n<p>Walsh was born into an immigrant family in the Boston neighborhood of Dorchester. His father was a laborer who belonged to the Laborers International Union of North America (Laborers or LIUNA) Local 223 in Boston. Marty joined that same union in 1998 at age 21 and was elected president in 2005. In 2010, Walsh was also elected secretary-treasurer and general agent of the Boston Building Trades Council, and in 2011 he was elected to lead the organization.&nbsp;<\/p>\n\n\n\n<p>From 1997 until 2014, Walsh was a member of the Massachusetts House of Representatives.&nbsp; During his tenure, he served as chairman of the Committee on Ethics and as a co-chair of the Massachusetts Democratic Party Labor Caucus. Walsh stepped down from his leadership positions when he was elected mayor of Boston in 2013.&nbsp;<\/p>\n\n\n\n<p>Throughout his career, Walsh has prioritized the needs of workers. As a union leader, he led negotiations that protected union members\u2019 benefits and pay when developers were more concerned with keeping costs down. He also pushed for the developers to hire only union workers, writes <a href=\"https:\/\/www.ufcw227.org\/ourvoice-blog\/2021\/1\/21\/getting-to-know-president-bidens-labor-department-nominee-marty-walsh\" target=\"_blank\" rel=\"noreferrer noopener\">United Food and Commercial Workers International Unions (UFCW) Local 227<\/a>.&nbsp;<\/p>\n\n\n\n<p>According to his biography with the <a href=\"https:\/\/www.boston.gov\/departments\/mayors-office\/martin-j-walsh\" target=\"_blank\" rel=\"noreferrer noopener\">City of Boston<\/a>, while serving as mayor, Walsh focused on attracting private-sector employers to the city, created a \u201clearn and earn\u201d apprenticeship program for low-income workers, led local and national conversations about income inequality, and established an Office of Financial Empowerment.&nbsp;<\/p>\n\n\n\n<p>Bloomberg reporters <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2021-01-07\/biden-names-boston-mayor-walsh-to-head-labor-department\" target=\"_blank\" rel=\"noreferrer noopener\">Benjamin Penn, Josh Eidelson, and Jennifer Epstein<\/a> note he also signed \u201can executive order certifying that vendors with city contracts don\u2019t engage in \u2018wage theft,\u2019 and lobbied \u201cfor an ordinance establishing six weeks of paid parental leave for city employees.\u201d<\/p>\n\n\n\n<p>Walsh\u2019s efforts on behalf of workers demonstrates that \u201che is the type of individual who has never forgotten where he came from,\u201d <a href=\"https:\/\/www.liuna.org\/news\/story\/liuna-congratulates-marty-walsh-on-mayoral-advancement\" target=\"_blank\" rel=\"noreferrer noopener\">Terry O\u2019Sullivan<\/a>, general president of LIUNA, said during the mayoral run.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Walsh Garners Union Support as Labor Secretary<\/h3>\n\n\n\n<p>It\u2019s been over 50 years since a union member has served as labor secretary of the United States, reports <a href=\"https:\/\/www.npr.org\/sections\/biden-transition-updates\/2021\/01\/07\/954500709\/biden-to-tap-boston-mayor-marty-walsh-as-labor-secretary\" target=\"_blank\" rel=\"noreferrer noopener\">Benjamin Swasey<\/a>, deputy political editor for NPR. The nomination and confirmation of former union leader Marty Walsh, whom Senator <a href=\"https:\/\/twitter.com\/SenWarren\/status\/1347264714791931905?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1347264714791931905%7Ctwgr%5E%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fwww.wbur.org%2Fnews%2F2021%2F01%2F07%2Fboston-mayor-marty-walsh-biden-labor-secretary\" target=\"_blank\" rel=\"noreferrer noopener\">Elizabeth Warren<\/a> describes as \u201ca champion for America\u2019s labor unions and a fierce fighter for working families,\u201d reverses that trend.<\/p>\n\n\n\n<p>\u201cHis appointment is a signal that Biden will make a priority of a labor agenda,\u201d write Penn, Eidelson and Epstein. That\u2019s why his nomination received so much support from labor leaders.&nbsp;<\/p>\n\n\n\n<p>\u201cAs Boston mayor and throughout his career, Marty Walsh has always been a champion for American workers,\u201d UFCW International President <a href=\"https:\/\/www.ufcw.org\/press-releases\/ufcw-biden-labor-secretary-pick-marty-walsh-a-strong-champion-for-american-workers-on-the-frontlines-of-covid-19\/\" target=\"_blank\" rel=\"noreferrer noopener\">Marc Perrone<\/a> said in a statement. \u201cWhether it was standing with Stop &amp; Shop grocery workers striking to protect their health care, creating good union jobs, or supporting a strong minimum wage for Boston workers, Walsh has always put hardworking families first.\u201d<\/p>\n\n\n\n<p>\u201cMarty is a star, and he could hit the ground running as far as dealing with the issues and impact on working families,\u201d says <a href=\"https:\/\/www.politico.com\/news\/2021\/01\/07\/biden-chooses-boston-mayor-walsh-as-labor-secretary-455899\" target=\"_blank\" rel=\"noreferrer noopener\">Lee Saunders<\/a> president of the American Federation of State, County and Municipal Employees.&nbsp;<\/p>\n\n\n\n<p>And he has some very challenging issues to confront, writes <a href=\"https:\/\/www.npr.org\/2021\/03\/22\/975397099\/marty-walsh-boston-mayor-with-union-roots-confirmed-as-labor-secretary-at-key-ti\" target=\"_blank\" rel=\"noreferrer noopener\">Sam Gringlas<\/a>, journalist at NPR&#8217;s All Things Considered. The most pressing are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>high unemployment rates.<\/li><li>workplace safety.<\/li><li>raising the federal minimum wage.<\/li><li>protecting the power of unions.<\/li><li>battling inequality and discrimination.<\/li><li>overturning labor rules that put workers at a disadvantage.<\/li><\/ul>\n\n\n\n<p>\u201cThe problems are huge,\u201d says <a href=\"https:\/\/www.bostonglobe.com\/2021\/01\/18\/business\/labor-secretary-marty-walsh-would-face-daunting-challenges-high-expectations\/\" target=\"_blank\" rel=\"noreferrer noopener\">John Logan<\/a>, professor and department chair of labor and employment studies at San Francisco State University. \u201cIt would have been a tough job anyway, but you combine this neglect and the deliberate . . . sort of running [labor] agencies into the ground that took place during the Trump administration, you combine that with the incredible importance that we have in protecting workers from COVID . . . It\u2019s an enormous job.\u201d<\/p>\n\n\n\n<p>With his background and history, it\u2019s a job that many workers, labor leaders and advocates feel Walsh is prepared to handle.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"400\" height=\"372\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image1-2.jpg\" alt=\"Lauren McFerran smiles at camera; Biden appoints Labor Secretary Marty Walsh and Lauren McFerran concept\" class=\"wp-image-2466\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image1-2.jpg 400w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/05\/image1-2-300x279.jpg 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Chairman Lauren McFerran Will Put Workers First at the NLRB<\/h2>\n\n\n\n<p>Under the Trump administration, the NLRB became a \u201crogue\u201d agency that went against everything it was founded upon, writes <a href=\"https:\/\/www.thenation.com\/article\/politics\/nlrb-workers-rights-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Lynn Rhinehart<\/a>, senior fellow at the Economic Policy Institute (EPI) and former general counsel of the AFL-CIO.&nbsp;<\/p>\n\n\n\n<p>Instead of protecting workers\u2019 rights, \u201cin decision after decision, the NLRB has stripped workers of their protections under the law, restricted their ability to organize at their workplace, slowed down the union election process to give employers more time to campaign against the union, repealed rules holding employers accountable for their actions, and undermined workers\u2019 bargaining rights,\u201d she asserts.&nbsp;<\/p>\n\n\n\n<p>\u201cIn the two years that Republicans have held the majority on the board, they have overturned NLRB precedent in more than a dozen cases. All of these decisions overturning precedent favor employers,\u201d write Rhinehart and her EPI co-authors <a href=\"https:\/\/www.epi.org\/publication\/unprecedented-the-trump-nlrbs-attack-on-workers-rights\/\" target=\"_blank\" rel=\"noreferrer noopener\">Celine McNicholas and Margaret Poydock<\/a>.<\/p>\n\n\n\n<p>Holding fast to his campaign promises to be a pro-worker president, one of President Biden\u2019s first acts as president was to fire NLRB General Counsel Pete Robb in order to bring in leadership that would prioritize workers and uphold the National Labor Relations Act (NLRA). One of those leaders is Lauren McFerran whom Biden appointed as chairman of the NLRB.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">An Advocate for Working People<\/h3>\n\n\n\n<p>Lauren McFerran is no stranger to representing the interests of working people. She served as a NLRB board member from 2014 until her appointment as chairman. Prior to that, she served as senior labor counsel, deputy staff director and chief labor counsel for the Senate Committee on Health, Education, Labor, and Pensions.&nbsp;<\/p>\n\n\n\n<p>Through her efforts, she has built a reputation as a defender of workers and earned the support of labor leaders who believe she will refocus the board on its founding principle of protecting the interests of working people.&nbsp;<\/p>\n\n\n\n<p>\u201cThe appointment of New Chairman McFerran will restore faith and credibility at the NLRB to enforce and promote the laws to protect working Americans and their families,\u201d Amalgamated Transit Union International President <a href=\"https:\/\/www.atu.org\/media\/releases\/atu-biden-removal-of-nlrbs-peter-robb-and-appointment-of-lauren-mcferran-as-chairman-strong-first-steps-for-workers\" target=\"_blank\" rel=\"noreferrer noopener\">John Costa<\/a> said in a statement.<\/p>\n\n\n\n<p>Early comments by McFerran in her new role signal her intention to live up to those expectations by reversing Trump-era rulings and expanding union and worker rights under the NLRA.&nbsp;<\/p>\n\n\n\n<p>According to a report by Bloomberg Law reporter <a href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/new-nlrb-chair-gives-roadmap-for-possible-actions-under-biden\" target=\"_blank\" rel=\"noreferrer noopener\">Ian Kullgren<\/a>, McFerran\u2019s roadmap for the future of the NLRB indicates she will revisit decisions regarding worker classification, the use of company email for union purposes, limits placed on the display of pro-union paraphernalia in workplaces, and the ability for faculty at nonprofit religious colleges to unionize.<\/p>\n\n\n\n<p>\u201cI look forward to this new chapter in the Board\u2019s work, redoubling our efforts to serve the Act\u2019s goals &#8212; \u2018encouraging the practice and procedure of collective bargaining and&#8230;protecting the exercise by workers of full freedom of association\u2019,\u201d says <a href=\"https:\/\/www.nlrb.gov\/news-outreach\/news-story\/president-appoints-lauren-mcferran-nlrb-chairman\" target=\"_blank\" rel=\"noreferrer noopener\">McFerran<\/a>.&nbsp;<\/p>\n\n\n\n<p>In choosing Walsh and McFerran, Biden is honoring his promise to usher in a new era where advancing workers\u2019 rights is a priority. Both of these new leaders have the experience to bring about pro-worker changes to two of the federal agencies that have great influence over labor laws.&nbsp;<\/p>\n\n\n\n<p><small><em>Images by:
