This means more than 70,000 drivers will receive some workplace benefits such as minimum wage and paid time off, report <a href=\"https:\/\/www.cnbc.com\/2021\/03\/16\/uber-grants-uk-drivers-worker-status-after-losing-major-labor-battle.html\" target=\"_blank\" rel=\"noreferrer noopener\">Deirdre Bosa and Laura Batchelor<\/a> at CNBC.<\/p>\n\n\n\n<p>It\u2019s a hard-earned victory after a five-year legal battle, and one that will likely inspire drivers and other gig economy workers around the world to keep fighting for more rights when working for app-based companies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rideshare Driver Unrest Has Been Brewing<\/h2>\n\n\n\n<p>Since their inception, rideshare companies \u2014 like most other app-based gig economy organizations \u2014 have been classifying those who work for them as independent contractors. For workers, this means being denied basic workplace benefits and protections such as health insurance, a minimum wage and paid time off.&nbsp;<\/p>\n\n\n\n<p>For those who drive to earn money to supplement their primary income, this isn\u2019t necessarily a bad thing. \u201cI don&#8217;t want to be an employee. I like and need the flexibility of the gig,\u201d one driver told <a href=\"https:\/\/www.businessinsider.com\/uber-drivers-disappointed-ruling-not-employees-2019-5\" target=\"_blank\" rel=\"noreferrer noopener\">Graham Rapier<\/a>, associate business editor at Insider. Another part-time driver said: \u201cUber is a part time gig to supplement your income and I believe it does that well. People shouldn&#8217;t count on it as a full time job to put food on the table.\u201d<\/p>\n\n\n\n<p>But the reality is some workers do rely on their income from Uber, Lyft and other rideshare companies. That\u2019s why they have been fighting to be reclassified as employees.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Protests Begin<\/h3>\n\n\n\n<p>The history of activism by Uber drivers dates back to October 22, 2014 when Uber drivers organized together to host a \u201cGlobal Day of Protest.\u201d On this date, drivers turned off their apps and stopped picking up passengers in protest of unjust working conditions and lessening shares in company profits, associate editor at In These Times <a href=\"https:\/\/inthesetimes.com\/article\/the-sharing-economy-first-strike-uber-drivers-turn-off-the-app\" target=\"_blank\" rel=\"noreferrer noopener\">Rebecca Burns<\/a> reported during the unrest.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>That first sign of organization by Uber drivers led to countless other protests around the world by rideshare drivers. The most notable was in 2019 when drivers in cities across the globe went on strike to protest poor pay and working conditions.&nbsp;<\/p>\n\n\n\n<p>On May 8, 2019, strikes were organized nationwide by groups including <a href=\"https:\/\/www.drivers-united.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rideshare Drivers United<\/a>, the <a href=\"https:\/\/bidg.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Boston Independent Drivers Guild<\/a>, and <a href=\"https:\/\/drivingguild.org\/welcome-chicago\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chicago Rideshare Advocates<\/a> (now part of the Independent Drivers Guild). The Teamsters Union also came out in support of drivers. \u201cThese protests remind the world that while there are tech companies valued at billions of dollars, those same companies have drivers who are struggling to get by,\u201d said Teamsters President <a href=\"https:\/\/teamster.org\/2019\/05\/teamsters-union-stands-solidarity-uber-lyft-drivers\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jim Hoffa<\/a>. \u201cWe stand in solidarity with drivers at Uber and Lyft who have a right to be paid fairly and have dignified working conditions.\u201d<\/p>\n\n\n\n<p>In the U.K. that same day, protests were organized by driver groups such as the <a href=\"https:\/\/uphd.org.uk\/\" target=\"_blank\" rel=\"noreferrer noopener\">United Private Hire Drivers Branch<\/a> of the Independent Workers Union of Great Britain (IWGB). \u201cDrivers are protesting against the IPO which will lead to large payouts for executives and venture capitalist investors, despite failures to resolve pay issues for drivers,\u201d wrote <a href=\"https:\/\/iwgb.org.uk\/post\/5ccbedcee58ac\/uber-drivers-plan-national-shu\" target=\"_blank\" rel=\"noreferrer noopener\">IWGB<\/a> staff in a statement about the protests.&nbsp;<\/p>\n\n\n\n<p>The streets aren\u2019t the only places drivers are making their demands heard. They have also filed multiple lawsuits against the companies. One of those was filed by two drivers in the U.K. in 2016.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1280\" height=\"853\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image2-2.jpg\" alt=\"smiling driver; uk uber drivers ruling concept\" class=\"wp-image-2438\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image2-2.jpg 1280w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image2-2-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image2-2-1024x682.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image2-2-768x512.jpg 768w\" sizes=\"auto, (max-width: 1280px) 100vw, 1280px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">A Timeline of Events in the U.K. Uber Drivers\u2019 Victory&nbsp;<\/h2>\n\n\n\n<p>In 2016 a group of Uber drivers, led by Yaseen Aslam and James Farrar brought forward their argument that they are employees of Uber to an employment tribunal in the U.K. The drivers won their case which was described as a \u201cmonumental victory\u201d by <a href=\"https:\/\/www.bbc.com\/news\/business-37802386\" target=\"_blank\" rel=\"noreferrer noopener\">Maria Ludkin<\/a>, former legal director at the GMB Trade Union.<\/p>\n\n\n\n<p>\u201cI think it&#8217;s a massive achievement in a way that we were able to stand up against a giant,\u201d says <a href=\"https:\/\/www.bbc.com\/news\/business-56123668\" target=\"_blank\" rel=\"noreferrer noopener\">Yaseen Aslam<\/a>, now president of the App Drivers and Couriers Union (ADCU). \u201cWe didn&#8217;t give up and we were consistent &#8211; no matter what we went through emotionally or physically or financially, we stood our ground.\u201d&nbsp;<\/p>\n\n\n\n<p>Though they certainly scored a victory that day, their fight was far from over. Uber appealed the ruling in 2017 and 2018, but both the Employment Appeal Tribunal and the Court of Appeal upheld the original ruling by the employment tribunal. Uber then made its last appeal to the Supreme Court, which also upheld the ruling.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Supreme Court Rules in Favor of the Drivers<\/h3>\n\n\n\n<p>On February 19, 2020, the Supreme Court handed down its unanimous decision that Uber drivers should be classified as workers in the U.K. That classification, writes New Scientist technology reporter <a href=\"https:\/\/www.newscientist.com\/article\/2268594-uber-drivers-are-workers-rules-uk-supreme-court-what-happens-next\/\" target=\"_blank\" rel=\"noreferrer noopener\">Matthew Sparkes<\/a>, entitles drivers to receive some benefits such as a minimum wage and holiday pay, but not the full benefits that those classified as employees receive.&nbsp;<\/p>\n\n\n\n<p>\u2018\u201cThe employment tribunal was right to find that Uber drivers are workers who therefore qualify for the rights conferred on workers by employment legislation,\u2019 said Judge <a href=\"https:\/\/www.nbcnews.com\/news\/world\/uber-drivers-are-workers-u-k-supreme-court-rules-n1258314\" target=\"_blank\" rel=\"noreferrer noopener\">George Leggatt<\/a> as he read out a summary of the ruling\u2026 \u2018Drivers are in a position of subordination and dependency to Uber,\u2019 with little ability to improve their economic position. The only way to increase their earnings is by \u2018working longer hours while constantly meeting Uber&#8217;s measures of performance,\u2019\u201d reports The Associated Press.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/www.jdsupra.com\/legalnews\/uk-supreme-court-ruling-uber-drivers-5251635\" target=\"_blank\" rel=\"noreferrer noopener\">ruling by the court<\/a> officially classifies drivers as workers from the time they log into the app rather than only when they are transporting passengers. It\u2019s a decision that ADCU general secretary <a href=\"https:\/\/www.cnbc.com\/2021\/02\/19\/uk-supreme-court-rules-uber-drivers-are-workers-not-contractors.html\" target=\"_blank\" rel=\"noreferrer noopener\">James Farrar<\/a> says will \u201cfundamentally re-order the gig economy and bring an end to rife exploitation of workers by means of algorithmic and contract trickery.\u201d<\/p>\n\n\n\n<p>\u201cI am delighted that workers at last have some remedy because of this ruling, but the government must urgently strengthen the law so that gig workers may also have access to sick pay and protection from unfair dismissal,\u201d Farrar adds.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1280\" height=\"853\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image3-2.jpg\" alt=\"rideshare driver looks back over shoulder, smiling at passenger; uk uber drivers ruling concept\" class=\"wp-image-2439\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image3-2.jpg 1280w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image3-2-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image3-2-1024x682.jpg 1024w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2021\/04\/image3-2-768x512.jpg 768w\" sizes=\"auto, (max-width: 1280px) 100vw, 1280px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">One Battle Won in an Ongoing Struggle<\/h2>\n\n\n\n<p>Even after the ruling, Uber still contends that drivers are contractors and the decision only applies to the drivers named in the original employment tribunal, not to current and future staff, Sparkes writes.&nbsp;<\/p>\n\n\n\n<p>Labor leaders like <a href=\"https:\/\/www.smartcitiesdive.com\/news\/what-uks-uber-ruling-could-mean-for-the-global-gig-economy\/595468\/\" target=\"_blank\" rel=\"noreferrer noopener\">Greg Regan<\/a>, president at Transportation Trades Department, AFL-CIO, warn against such strategies by Uber to avoid its responsibilities to drivers. \u201cIt is imperative that policymakers in the U.S., in Europe, and across the globe realize that companies like Uber, Lyft, and DoorDash are bad actors \u2014 they have no intention of ever acknowledging workers&#8217; rights,\u201d he writes. \u201cIt is up to leaders at every level of government to hold the ride-hailing industry accountable and make sure companies like Uber and Lyft abide by existing law and court rulings like this one.\u201d<\/p>\n\n\n\n<p>How that is achieved will be another chapter in the seemingly unending story of gig economy workers versus the technology companies.
