{"id":1528,"date":"2019-07-23T06:00:44","date_gmt":"2019-07-23T06:00:44","guid":{"rendered":"http:\/\/www.uniontrack.com\/blog\/?p=1528"},"modified":"2019-07-23T11:30:16","modified_gmt":"2019-07-23T11:30:16","slug":"forced-arbitration-protests","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/forced-arbitration-protests","title":{"rendered":"How Recent Protests Could Spell the End of Forced Arbitration"},"content":{"rendered":"<p>Ken Green<br \/>\nCEO\/Founder<br \/>\n<a href=\"https:\/\/www.uniontrack.com\/\">UnionTrack, Inc.<\/a><\/p>\n<p>Workers in the gaming and technology industries are starting to flex their collective muscles to push back against labor practices that suppress their rights in the workplace.\u00a0<\/p>\n<p>A wave of dissension in several companies is shifting the dynamic between employees and employers, forcing companies to reevaluate commonly accepted workplace practices that put company needs ahead of workers\u2019 needs. For example, <a href=\"https:\/\/www.uniontrack.com\/blog\/video-game-unions\">game developers are challenging the issue of crunch time<\/a>, which requires workers to work 60- or even 80-hour weeks in the run-up to the release of a game.<\/p>\n<p>Another issue that has been pushed to the forefront is forced arbitration. Forced arbitration puts employees at a disadvantage because it \u201cdenies individuals access to our country&#8217;s civil justice system when employers violate our nation&#8217;s employment and civil rights laws,\u201d explains <a target=\"_blank\" href=\"https:\/\/www.nela.org\/index.cfm?pg=mandarbitration\">Laura Flegel<\/a>, legislative and public policy director for the National Employment Lawyers Association.<\/p>\n<p>At companies such as Riot Games and Google, mandatory arbitration has recently been used to keep sexual harassment claims and disputes out of the public spotlight and in private arbitration. Workers at these companies are calling foul.\u00a0<\/p>\n<h2>Why the Issue of Forced Arbitration Is Important<\/h2>\n<p>More than half of America\u2019s Fortune 100 companies impose forced arbitration clauses on employees, reports <a target=\"_blank\" href=\"http:\/\/employeerightsadvocacy.org\/wp-content\/uploads\/2018\/03\/NELA-Institute-Report-Widespread-Use-of-Workplace-Arbitration-March-2018.pdf\">Imre S. Szalai<\/a>, professor of social justice at Loyola University New Orleans College of Law. The closed-door, employer-led nature of forced arbitration puts employees in a defensive position from the beginning when they have grievances against their employers.\u00a0<\/p>\n<p>\u201cBecause of forced arbitration, critical wage claims and civil rights claims\u2014which can deeply impact vulnerable workers\u2014may never be heard in a public, open court, where employee plaintiffs are guaranteed important procedural protections,\u201d concludes Szalai.<\/p>\n<p>And that\u2019s only if they decide to bring a claim forward. <a target=\"_blank\" href=\"https:\/\/www.epi.org\/publication\/the-growing-use-of-mandatory-arbitration-access-to-the-courts-is-now-barred-for-more-than-60-million-american-workers\/\">Alexander J.S. Colvin<\/a>, associate dean for academic affairs, diversity, and faculty development at Cornell University\u2019s ILR School, notes in a study for the Economic Policy Institute (EPI) that mandatory arbitration actually suppresses worker claims because workers are reticent to even attempt to fight the battle they know is lost.<\/p>\n<p>\u201cEmployers adopting mandatory employment arbitration have been successful in coming up with a mechanism that effectively reduces their chance of being subject to any liability for employment law violations to very low levels,\u201d reports Colvin.\u00a0<\/p>\n<p>A key reason for this is that attorneys who represent employees are reluctant to even take on claims cases that are subject to forced arbitration because they are less likely to win those cases. Workers with grievance cases are often left without resources to bring lawsuits forward. Further, workers are without much support in challenging forced arbitration in the courts thanks to a recent Supreme Court ruling that allows companies to enforce it.\u00a0<\/p>\n<p>In Epic Systems Corp. v Lewis, the court ruled 5\u20134 that companies can require employees to relinquish their right to sue on both an individual basis and as a collective. A report, co-authored by researchers from the <a target=\"_blank\" href=\"https:\/\/www.epi.org\/files\/uploads\/Unchecked-Corporate-Power-web.pdf\">Center for Popular Democracy<\/a> and the EPI, contend that because of this ruling, by 2024 more than 80 percent of private-sector nonunion workers will be denied access to courts through forced arbitration clauses.<\/p>\n<p>The best option left open to workers to fight the practice is to convince their employers to drop mandatory arbitration.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image1-3.jpg\" alt=\"Angry dissatisfied businesswoman holding contract arguing with contractor, pointing at terms failed to perform, demanding termination, loss compensation, defrauded cheated investor protecting rights, forced arbitration concept\" width=\"1200\" height=\"800\" class=\"alignnone size-full wp-image-1531\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image1-3.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image1-3-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image1-3-768x512.jpg 768w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image1-3-1024x683.jpg 1024w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<h2>Workers at Riot Games Are Fighting Forced Arbitration<\/h2>\n<p>Employees at video game development company Riot Games have been actively protesting the company\u2019s forced arbitration policy.\u00a0<\/p>\n<p>The conflict started with a story by <a target=\"_blank\" href=\"https:\/\/kotaku.com\/inside-the-culture-of-sexism-at-riot-games-1828165483\">Cecilia D&#8217;Anastasio<\/a> at Kotaku that alleged ongoing sexual discrimination and harassment abuses against the women who work at Riot Games. A number of former and current employees almost immediately sued the company for sexist practices.\u00a0<\/p>\n<p>The company responded in late April 2019 by forcing two of those workers into arbitration. The effects of this decision were almost instantaneous, setting off a chain of events that is reverberating throughout the company and industry:<\/p>\n<ul>\n<li><strong>Friday, May 3<\/strong> \u2014 Riot Games responded to reports of an upcoming walkout by issuing a <a target=\"_blank\" href=\"https:\/\/www.riotgames.com\/en\/news\/commitments-on-arbitration-and-cultural-transformation\">statement<\/a> that left the mandatory arbitration policy in place until after all current litigation is resolved. This left workers angry. Walkout organizer and Riot Games employee <a target=\"_blank\" href=\"https:\/\/www.jacobinmag.com\/2019\/05\/video-game-workers-walkout-riot-games\">Jocelyn Monahan<\/a> said the company\u2019s response wasn\u2019t good enough. \u201cThis current conversation started because [mandatory arbitration] is being used against people who are current employees of the company,\u201d Monahan told Jacobin magazine. \u201cThey\u2019re the ones who deserve our support the most, and using them as collateral damage to have a future conversation is unacceptable.\u201d<\/li>\n<li><strong>Monday, May 6<\/strong> \u2014 <a target=\"_blank\" href=\"https:\/\/kotaku.com\/over-150-riot-employees-walk-out-to-protest-forced-arbi-1834566198\">More than 150 Riot Games<\/a> workers take a rare step for employees in the gaming industry and walk out on the job to protest the company\u2019s stance on forced arbitration. The workers issued a May 16 deadline to the company to make changes to the policy or the workers would take further actions.\u00a0<\/li>\n<li><strong>Friday, May 17<\/strong> \u2014 Riot Games issued another <a target=\"_blank\" href=\"https:\/\/www.riotgames.com\/en\/news\/announcing-new-forums-for-d-i-collaboration\">statement<\/a> maintaining their position of not changing their policy while in active litigation. The company claimed it would revisit the arbitration policy, and, at that time, will at minimum give new employees \u201cthe option to opt out of arbitration on individual sexual harassment claims.\u201d But not until current litigations are settled.<\/li>\n<\/ul>\n<p>The saga continues to unfold as the protesting workers prepare their response to the company\u2019s hard-line stance on its policy. It\u2019s an important conflict to follow because it\u2019s the first of its kind in the gaming industry. What happens at Riot Games will set an example for other gaming and even tech industry workers to collectively stand up to poor working conditions and potentially unionize, <a target=\"_blank\" href=\"https:\/\/blizzardwatch.com\/2019\/05\/17\/off-topic-riot-games-didnt-budge-response-walkout-walkout-still-matters\/\">Tyler Colp<\/a> writes at gaming website Blizzard Watch.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image2-3.jpg\" alt=\"The front of the Google Headquarters building, supporting forced arbitration concept\" width=\"1999\" height=\"1333\" class=\"alignnone size-full wp-image-1532\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image2-3.jpg 1999w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image2-3-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image2-3-768x512.jpg 768w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/07\/image2-3-1024x683.jpg 1024w\" sizes=\"auto, (max-width: 1999px) 100vw, 1999px\" \/><\/p>\n<h2>How Google Employees Paved a Path of Possibilities<\/h2>\n<p>The protest on Riot Games comes on the heels of a similar walkout at Google that resulted in a victory for employees.\u00a0<\/p>\n<p>On November 1, 2018, some 20,000 Google employees around the world staged a walkout to protest the company\u2019s handling of assault and harassment charges brought by employees. <a target=\"_blank\" href=\"https:\/\/www.thecut.com\/2018\/11\/google-walkout-organizers-explain-demands.html\">The organizers<\/a> of the walkout listed among their core demands the end of forced arbitration in cases of harassment and discrimination for all current and future employees.<\/p>\n<p>This was a big moment for workers in the tech sector because it was one of the largest efforts of collective action in the industry. In a show of collaboration and solidarity, the workers created the <a target=\"_blank\" href=\"https:\/\/sites.google.com\/view\/endforcedarbitration\/home\">Googlers for Ending Forced Arbitration<\/a>, which serves to help all locations unite under the banner of protesting forced arbitration.\u00a0<\/p>\n<p>A week after the protests, Google issued a <a target=\"_blank\" href=\"https:\/\/www.blog.google\/inside-google\/company-announcements\/note-our-employees\/\">formal response<\/a> to employees\u2019 demands, one of which was the end of forced arbitration in sexual harassment and assault claims. This was a big win that demonstrated the potential power of collective action on the part of employees in non-unionized workplaces.\u00a0<\/p>\n<p>Mandatory arbitration is an anti-worker policy that companies force upon employees to limit their ability to address grievances against the company in public courts. Workers in nonunion industries subject to this practice have begun to stand up for themselves and demand an end to a policy that puts them at a distinct disadvantage in fighting workplace wrongs.
