{"id":1433,"date":"2019-05-14T06:00:34","date_gmt":"2019-05-14T06:00:34","guid":{"rendered":"http:\/\/www.uniontrack.com\/blog\/?p=1433"},"modified":"2019-05-13T22:46:12","modified_gmt":"2019-05-13T22:46:12","slug":"aftermath-of-janus-ruling","status":"publish","type":"post","link":"https:\/\/uniontrack.com\/blog\/aftermath-of-janus-ruling","title":{"rendered":"Public-Sector Unions Hold Strong in the Aftermath of the Janus Ruling"},"content":{"rendered":"<p>Ken Green<br \/>\nCEO\/Founder<br \/>\n<a href=\"https:\/\/www.uniontrack.com\/\">UnionTrack, Inc.<\/a><\/p>\n<p>The Supreme Court\u2019s ruling on the Janus case is one of the most pivotal legislative moments in modern labor history \u2014 so much so that many predicted it would be the end of some public-sector unions because of the potential catastrophic damage in membership and financial security.<\/p>\n<p>Because the ruling allows public-sector employees around the nation to opt out of paying agency fees, even if they are represented by collective bargaining, most people assumed there would be a mass exodus from public-sector unions. Workers would now be able to enjoy the benefits of collective bargaining without having to contribute financially. <\/p>\n<p>While the decision was certainly a blow, it has not had the expected dire consequences to the public-sector unions that most anticipated. In fact, some public-sector unions saw an increase in membership, note <a target=\"_blank\" href=\"https:\/\/www.governing.com\/topics\/workforce\/gov-janus-impact-union-membership.html\">Katherine Barrett and Richard Greene<\/a>, government researchers and correspondents for Governing Magazine.<\/p>\n<p>As <a target=\"_blank\" href=\"https:\/\/www.ilr.cornell.edu\/programs\/professional-programs\/lb550\/managing-labors-values-part-1-helping-your-staff-succeed\">Kim Cook<\/a>, extension faculty at the Cornell University Worker Institute, emphasizes to Barrett and Greene, \u201cI think the right wing thought this would decimate public-sector unions, and they were clearly wrong.\u201d<\/p>\n<p>True, the ruling has hurt unions financially by denying them the cash flow. But what it did not do was eliminate the incentives for workers to join unions, explains New York Magazine journalist <a target=\"_blank\" href=\"http:\/\/nymag.com\/intelligencer\/2018\/12\/supreme-court-union-membership-janus.html\">Sarah Jones<\/a>. Most members have stood by their unions, demonstrating a united front to support the work that unions do for public-sector workers. <\/p>\n<h2>A Peek at Janus\u2019 Impact on Public-Sector Union Membership<\/h2>\n<p>According to the <a target=\"_blank\" href=\"https:\/\/www.bls.gov\/news.release\/union2.nr0.htm\">Bureau of Labor Statistics<\/a>, the number of public-sector workers represented by a union declined by 83,000 in 2018, which represents a drop in member of less than 1 percent.<\/p>\n<p><a target=\"_blank\" href=\"https:\/\/www.afscme.org\/news\/press-room\/press-releases\/2019\/workers-chose-to-stick-with-their-union\">Lee Saunders<\/a>, president of the American Federation of State, County and Municipal Employees (AFSCME), says the membership numbers prove that \u201cpublic service workers are resilient and see the value of union membership.\u201d<\/p>\n<p>Not all unions are required to release their membership numbers, but here\u2019s a look at the impact the Janus ruling had on <em>some <\/em>states and unions that did release some of that data.<\/p>\n<ul>\n<li>The <a target=\"_blank\" href=\"https:\/\/cei.org\/blog\/union-membership-post-janus\">National Education Association<\/a> lost 87,000 agency-fee payers, but gained 15,439 new members in 2018. <\/li>\n<li><a target=\"_blank\" href=\"https:\/\/www.afscme.org\/news\/press-room\/press-releases\/2019\/workers-chose-to-stick-with-their-union\">AFSCME<\/a> reported gaining 9,097 new members, but still showed a six-percent drop overall because of the loss of about 100,000 agency fee payers. <\/li>\n<li>The <a target=\"_blank\" href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/mass-exodus-of-public-union-fee-payers-after-high-court-ruling\">Service Employees International Union<\/a> lost 4,500 members.<\/li>\n<li>The <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2019\/02\/12\/labor-union-conference-teacher-strike-janus\/\">American Federation of Teachers<\/a> (AFT) lost 84,500 agency-fee payers after Janus, but it gained 88,000 new members.<\/li>\n<\/ul>\n<p>This is but a small sample based on the available data of public-sector unions that were impacted by Janus. The trend here is more unions gained new dues-paying members than lost members after the ruling. <\/p>\n<p>A big part of that sustainability can be attributed to an increase in activism in response to the ruling. San Diego Education Association President <a target=\"_blank\" href=\"https:\/\/www.kpbs.org\/news\/2018\/sep\/07\/back-school-post-janus-how-supreme-court-ruling-ha\/\">Kisha Borden<\/a> expresses the sentiment of many union leaders that the Janus ruling has \u201creinvigorated members.\u201d Her union sees the anti-union legislation as an opportunity to rally members at a time when they may be most fired up about protecting their rights.<\/p>\n<p>Most union leaders are also attributing their success at weathering the storm to proactive engagement campaigns that started before the Janus decision was handed down. <a target=\"_blank\" href=\"https:\/\/www.washingtonpost.com\/opinions\/so-much-for-the-labor-movements-funeral\/2019\/01\/25\/53e5389c-20c3-11e9-9145-3f74070bbdb9_story.html?noredirect=on&#038;utm_term=.20b5ee29fd9c\">Lily Eskelsen Garc\u00eda<\/a>, president of the National Education Association, asserts that the labor detractors pushing the Janus agenda actually \u201cshook us out of some complacency\u201d and pushed unions to work harder to engage members. \u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image3-1.jpg\" alt=\"Janus ruling\" width=\"1200\" height=\"769\" class=\"alignnone size-full wp-image-1438\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image3-1.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image3-1-300x192.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image3-1-768x492.jpg 768w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image3-1-1024x656.jpg 1024w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<h2>Engagement Campaigns Are Key to Sustaining Memberships<\/h2>\n<p>Even after Janus, many union members and agency-fee payers chose to stick by their unions because they saw the value in a membership. Public-sector unions were able to communicate with and engage their members in ways that instilled pride and determination. That <a target=\"_blank\" href=\"https:\/\/www.uniontrack.com\/blog\/union-brand\">engagement <\/a>was key to sustaining and even growing memberships during this tumultuous time. <\/p>\n<p>Those campaigns helped mitigate the threat of labor detractors\u2019 opt-out campaigns. The small changes in membership post-Janus reflect the \u201crobust internal organizing campaigns in public sector unions,\u201d says <a target=\"_blank\" href=\"https:\/\/news.bloomberglaw.com\/daily-labor-report\/mass-exodus-of-public-union-fee-payers-after-high-court-ruling\">Jeffrey Keefe<\/a>, researcher at the Economic Policy Institute.<\/p>\n<p>One such example is the <a target=\"_blank\" href=\"https:\/\/www.afscmestrong.org\/about\">AFSCME Strong<\/a> campaign, launched in anticipation of the Janus ruling. The key strategy of the campaign is to focus on people and to have personal conversations with members and agency-fee payers to encourage deeper engagement with the union. <\/p>\n<p>The NEA launched its New Ed Campaign in 2016 to engage its members. That campaign focuses on engaging new hires and talking to agency-fee payers to educate them on the value of membership, which makes it a perfect tool for the union\u2019s current efforts. <a target=\"_blank\" href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2018\/06\/janus-afscme-public-sector-unions\/563879\/\">Jim Testerman<\/a>, the senior director at the NEA\u2019s Center for Organizing, says the union is also reaching out to members to show them that the NEA fights for more than salary, but also for social equality. \u201cWhen people actually see a movement that is giving voice to their profession and their students, they join their union,\u201d says Testerman.<\/p>\n<p>United Teachers Los Angeles (UTLA) took a boots-on-the-ground approach to talk to and educate members on what the union does for them. UTLA Field and Organizing Director <a target=\"_blank\" href=\"http:\/\/inthesetimes.com\/article\/21661\/public-sector-unions-response-to-janus\">Brian McNamara<\/a> says the conversations focused on emphasizing that the union is \u201cnot just an insurance policy\u201d against anti-union workplaces, but a \u201ctool for collective action.\u201d \u00a0\u00a0<\/p>\n<p>Duluth Federation of Teachers President <a target=\"_blank\" href=\"https:\/\/www.duluthnewstribune.com\/business\/4493995-immediate-impact-janus-decision-limited-though-challenges-remain\">Bernie Burnham<\/a> says his union \u201cworked really hard in the past few years to re-engage our folks about the value of belonging\u201d and asked members to reaffirm their commitment to the union. That outreach has put the union in a strong position post-Jauns.<\/p>\n<p>While these campaigns were born of a threat to membership, the lesson for unions is that activism and communication are key to survival. \u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image2-1.jpg\" alt=\"Janus ruling\" width=\"1200\" height=\"800\" class=\"alignnone size-full wp-image-1437\" srcset=\"https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image2-1.jpg 1200w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image2-1-300x200.jpg 300w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image2-1-768x512.jpg 768w, https:\/\/uniontrack.com\/blog\/wp-content\/uploads\/2019\/05\/image2-1-1024x683.jpg 1024w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><\/p>\n<h2>What Unions Have Learned About Activism in the Wake of Janus<\/h2>\n<p>The fact that these unions have maintained their membership levels during this time says a lot about the importance of having <a target=\"_blank\" href=\"https:\/\/www.uniontrack.com\/blog\/right-to-work-states\">an engaged union<\/a> that sees the value of membership. <\/p>\n<p>AFT President <a target=\"_blank\" href=\"https:\/\/theintercept.com\/2019\/02\/12\/labor-union-conference-teacher-strike-janus\/\">Randi Weingarten<\/a> says the ruling has actually been a learning opportunity for unions, pushing them to evaluate what their membership means and what value there is in belonging. She notes that unions have had to ask themselves: \u201cWhat\u2019s the community you are creating? And what are the values that people connect with \u2014 not just what\u2019s the transaction \u2014 but what are the values?\u201d<\/p>\n<p>That exploration for values, and how to use those values to connect with members, is probably the most important lesson for unions. <a target=\"_blank\" href=\"https:\/\/www.forbes.com\/sites\/mattpatterson\/2019\/03\/01\/public-employee-unions-still-kicking-and-screaming-after-janus\/#d24035a1b3bb\">Matt Patterson<\/a>, executive director of Free California, says that unions must maintain this momentum in advocacy and engagement.<\/p>\n<p>While the Janus decision definitely complicated things for unions, <a target=\"_blank\" href=\"https:\/\/reason.com\/archives\/2018\/09\/28\/unions-change-their-tune-on-janus-n\">Steven Greenhut<\/a>, contributing editor for the California Policy Center, observes that the most perceptive union leaders understand that the ruling has actually played a role in strengthening efforts to listen to their membership more closely. In the end, many union dues-paying membership numbers increased as a result of the \u201cattack\u201d of the Janus ruling, which is the complete opposite of most people\u2019s expectations.<\/p>\n<p>A crucial part of any engagement efforts is communication, and <a target=\"_blank\" href=\"https:\/\/www.uniontrack.com\/\">UnionTrack ENGAGE<\/a> can help union leaders reach their members and
